Working With 'The Problem Client': Skills in Client Management ON-DEMAND

All lawyers encounter clients who aren’t easy to work with. Whether its erratic communication patterns, unrealistic expectations about the legal process, high emotions, or questionable competency, some clients require more energy, time, and mental bandwidth. This CLE webinar will outline methods for managing client expectations, provide strategies for dealing with client conflict or misbehavior, and explore the ethical ramifications of determining client competency. The two-hour webinar will feature a panel of seasoned attorneys moderated by Kip Marshall.

Moderator:

Clifford “Kip” Marshall is a founding shareholder and the President of Marshall, Roth & Gregory, PC and has practiced law for more than 40 years in Asheville and the western region of North Carolina. He is admitted before all the courts of the State of North Carolina, the Cherokee Supreme Court, Eastern Band of Cherokee, the U.S. District Court for the Western, Middle and Eastern Districts of North Carolina and the United States Court of Appeals for the Fourth Circuit and the United States Court of Appeals for the District of Columbia. He is a certified North Carolina Superior Court mediator and has been called to mediate matters arising in the North Carolina courts and federal district courts.

Panelist:

Mary Euler is an attorney at McGuire, Wood, and Bissette uses her tested skills to help families, businesses and individuals solve disputes over wills, trusts, powers of attorney and other fiduciary and estate matters. She excels in cases where estate, trust and fiduciary matters touch other areas of the law including real estate, taxation, corporate, commercial and intellectual property matters. In addition to litigation and trials, Mary handles matters involving trustee vacancies, trust modifications and terminations requiring court approval, including issues involving charitable trusts.

Kerry Friedman is an Asheville native and graduate of Asheville High School. He attended the University of North Carolina at Chapel Hill (BA, Phi Beta Kappa, 1976) and the University of North Carolina at Chapel Hill School of Law (JD, 1980). Kerry returned to Asheville in 1980 and joined Patla, Straus, Robinson & Moore, P.A., becoming a partner in 1983. Kerry concentrates his practice in business, transactional and non-profit law.

Tikkun Gottschalk is currently an attorney at Deutsch and Gottschalk where he handles a variety of cases for the firm. In the last few years, most of his work has been in business transactions, real estate litigation, and estate administration. He also handles debt collection cases (for debtors and creditors), creditors’ rights in bankruptcy, traffic court citations, landlord and tenant disputes, real estate transactions, and estate planning. He also usually have at least one pro bono case he is working on as well.

Joy G. McIver is a Board Certified Family Law Specialist who has practiced family law, civil litigation and appellate practice in state and federal courts across Western North Carolina since 1996. She is currently practicing at Montford Family Law. In 2006, the North Carolina Dispute Resolution Commission as a Superior Court Mediator certified Joy. Recently, she received training in Collaborative Law. Joy is a graduate of the University of North Carolina at Chapel Hill School of Law where she obtained her JD in 1996.
