The U.S. Department of Transportation (DOT) has ruled that the DBE Program’s race and sex-based presumptions are unconstitutional, issuing an Interim Final Rule (IFR) effective October 3, 2025.

This means certified DBEs must take action to maintain certification under the newly revised

DBE Neutral Small Business Program.
