For decades, California businesses have relied on the long-standing Borello multi-factors when classifying workers as independent contractors.  In its stunning Dynamex decision on April 30, 2018, the California Supreme Court overturned the Borello test, supplanting it with a much shorter “ABC” test adopted from the Commonwealth of Massachusetts. This altered years of precedence and has left California businesses in an unexpected legal predicament about how to handle independent contractors both retroactively and prospectively.
