An Alternative Way to Resolve IP Disputes

IP disputes are often settled through litigation. However, Alternative Dispute Resolution (ADR) methods, such as arbitration, offer an alternative approach to resolve these conflicts. There are two notable advantages of using arbitration over settling multiple litigations across various jurisdictions. First, arbitration offers a faster and more cost-effective solution, as it consolidates the dispute into a single proceeding. Second, arbitration is conducted in a non-public manner, ensuring confidentiality and preserving sensitive information.

Due to its confidential nature, gaining a comprehensive understanding of how disputes are resolved through arbitration can be challenging. In this CHIZAI (IP) seminar, we are pleased to have Ken Korea, an active arbitrator, as our guest speaker. Ken will offer participants an insightful overview and detailed information on the general process of arbitration and its advantages.

Profile of Speaker:

Ken Korea is an attorney, arbitrator and mediator with 30 years of experience in intellectual property licensing, litigation, and technology transactions. He currently serves as a US and international arbitrator with leading arbitration institutions such as ICDR, AAA and WIPO. He also serves as a mediator and as a discovery master with several ADR panels.

Previously, Ken practiced law as a partner at leading US law firms and served as Senior Vice President of IP at Samsung Electronics. He has handled several hundred IP litigation including the Apple-Samsung patent war, negotiated several hundred patent license agreements including three of the largest patent cross license agreements, and helped clients acquire companies ranging from startups to a multibillion dollar company.

Ken teaches Technology Licensing as an adjunct professor at Santa Clara University School of Law and Mergers & Acquisitions as a guest lecturer at Northwestern University School of Law San Francisco Campus.

Ken received his bachelor’s degree in electrical engineering from Cornell University and J.D. from Northwestern University School of Law. Before entering private practice, Ken served as a judicial law clerk to a federal judge and as a federal prosecutor in N.D. Fla. where he tried more than 50 cases as first chair.

Bay Area CHIZAI* (IP) is a unique networking platform (*CHIZAI means IP in Japanese). This group holds a seminar and networking event regularly in the Bay Area. Members are IP professionals, who are doing or interested in Japanese IP practices. Professor Toshiko Takenaka and NEDO Silicon Valley office founded this group. It is currently organized by Reina Sato, a JPO senior examiner and current senior director at NEDO Silicon Valley Office.

  • No-confidential discussions: Information brought to the presentation or discussion should not include any confidential matters or other materials that may require non-disclosure agreement or any other legal arrangement.

  • Keeping privacy private: All participants and presenters should always feel free and safe to discuss information and their opinions openly and respectfully. The conversations should be shard commonly across all participants, however any discussion topics or comments must not be publicized without a consensus.

We are a group of curious people who are interested in learning anything about technical, legal and business practices of IP that moves us. We hope that all participants will enjoy the band-new conversation platform as a safe place to network and learn from each other for years to come.
