This course will focus on the historical policies behind, and the current provisions of, the American Indian Probate Reform Act (AIPRA) and its implementing federal regulations. In particular, we will explore the creation of this first federal Indian probate code, testate and intestate succession rules applicable to federal trust real property and trust personalty, and individual tribal codes adopted pursuant to AIPRA’s provisions. Additionally, this course seeks to develop the functional skills necessary to advise individual Indian trust property owners, draft estate planning documents, and represent clients before the Probate Hearings Division, Office of Hearings and Appeals, Department of the Interior.
