Privilege logging is an essential but increasingly burdensome aspect of litigation. As data volumes grow, the process has become costly, complex, and cumbersome. At the 2024 Legal Week Judges Debate keynote, Judge Peck noted, “[n]ow the privilege logs are like little novels, and there may be 10,000 or more entries. That is very expensive and is often useless to the other side in figuring out what is or isn’t privileged.” This program will examine the fundamentals of privilege determinations, explore cost-effective logging strategies, and assess how emerging technologies can streamline the process.
