This session is a jam format but will have select judges watching a rewarding for tricks, style, creativity and fun. Rules &amp; Important Information:- Entry is NOT guaranteed -Waiver must be signed at entry. If under the age of 18 there must be a legal guardian present.- First Come, First Served until we hit capacity- Doors at 11:00AM - RSVP Required.1 Person per RSVP- No Ins &amp; Outs - ZERO TOLERANCE for drugs or underage drinking. Available Onsite:- Restrooms.- Music.- Fun.- No professional photo, video, or audio gear. Including detachable lenses, tripods, commercial rigs, boom mics, cables, etc.- No handheld action video or camera devices (Ex. Go Pro).- No weapons or fireworks.- No chained or spiked accessories.- No outside food or beverages (including alcohol and candy).- No food or liquid containers.- No selfie-sticks or laser pointers.- No large purses / bags or backpacks over 12x12.- No drugs or paraphernalia.- No stickers, flyers, handbills, spray paint, markers or pens.- No pets.By RSVP'ing you are agreeing to join Vans mailing list. WAIVER AND RELEASE OF LIABILITY AND EXPRESS ASSUMPTION OF THE RISK AND GRANT OF MEDIA RIGHTS FOR THE 2019 VANS U.S. OPEN OF SURFING EVENTS AND ANY RELATED ACTIVITIES, EVENTS AND ACTIVATIONS (COLLECTIVELY, THE “EVENTS”). THIS IS A LIABILITY RELEASE. BY SIGNING IT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS AND ARE COMPLETELY RELEASING POTENTIAL CLAIMS. PLEASE READ IT CAREFULLY.THIS WAIVER AND RELEASE OF LIABILITY AND EXPRESS ASSUMPTION OF RISK AND GRANT OF MEDIA RIGHTS (THE “AGREEMENT”) IS A CONTRACT BETWEEN YOU AND VANS, A DIVISION OF VF OUTDOOR, LLC, ITS PARENTS, AFFILIATES, SUBSIDIARIES, EMPLOYEES, STAFF, CONTRACTORS, AGENTS, EVENT VENUE OPERATORS, LESSORS AND OWNERS AND VENDORS (COLLECTIVLEY, THE “COMPANY”), THE ASSOCIATION OF SURFING PROFESSIONALS LLC D/B/A WORLD SURF LEAGUE, A DELAWARE LIMITED LIABILITY COMPANY (“WSL”), INTERNATIONAL MERCHANDISING COMPANY, LLC (“IMC”) AND EACH OF THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS AND STAFF, AND EACH OF THEIR RESPECTIVE EVENT SPONSORS AND PARTNERS (TOGETHER WITH COMPANY, COLLECTIVELY, THE “RELEASED PARTIES”), AND IT GOVERNS YOUR PARTICIPATION IN OR WITH THE 2019 VANS U.S. OPEN OF SURFING, STOKE-O-RAMA, DUCT TAPE INVITATIONAL, AND ANY AND ALL SURFING, SKATEBOARDING, BICYCLE RIDING, BMX, OR ANY OTHER ACTIVITIES, ACTIVATIONS, COMPETITIONS, CONTESTS, PERFORMANCES, CHALLENGES, PROMOTIONAL EVENTS, RETAIL AND CONCESSION SERVICES, EXHIBITIONS, INSTRUCTION, SUPPORT, DEMONSTRATIONS AND CEREMONIES THAT TAKE PLACE AT OR IN CONNECTION WITH THE EVENTS, AT OR NEAR AN EVENT VENUE, TRAVELING TO OR FROM AN EVENT VENUE OR OTHERWISE. IF YOU AGREE TO BE BOUND BY THIS WAIVER AND RELEASE, SIGN THIS AGREEMENT. IF YOU DO NOT AGREE, THEN DO NOT SIGN AND YOU WILL NOT PARTICIPATE.Dangerous Activity. I verify that I have full knowledge of the risk involved in participation in the Events, which could include, without limitation, competing, officiating, observing, attending, assisting, performing, working, volunteering, presenting, surfing, riding, skateboarding, bicycle riding, BMX, roller skating or any other activity that takes place at the Events, including serious personal injury, paralysis, musculoskeletal injuries, cardiovascular injuries or trauma, neurological impairment, infection, heart attack, stroke and even death, falls which can result in serious injury or death, injury, damage or death due to negligence on the part of myself or other people around me, injury, damage or death due to improper use or failure of equipment or machinery and property damage, injury or death due to environmental, pollution, sun, weather or ocean conditions or sea life, being stung or bitten by an ocean creature, such as a jellyfish, stingray or shark, and/or being held under water by waves, ocean currents or ocean floor matter or injury, damage or death due to collision with water craft. I understand that participating in the Events is dangerous, that my safety and health cannot be guaranteed while participating in or observing the Events and related activities or visiting the Events venue. I am voluntarily participating in the Events with knowledge of the dangers involved, including without limitation, the risks of death, catastrophic failure of equipment, falling, disability, injury, loss, damages, the unavailability of medical care, or the negligence or deliberate act of another person and I agree to accept any and all risks of injury, personal or property damage or death. Assumption of Risks. Understanding, acknowledging and agreeing to all the risks and hazards involved with the Events, I freely and voluntarily choose to participate in the Events, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE EVENTS OR FROM ANY PRIZES THAT MAY BE AWARDED TO ME IN CONNECTION WITH THE EVENTS, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE EVENTS OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the Events or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and my and their respective property, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and my and their respective property.Representation as to Physical Condition. I have consulted with a qualified physician about my desired participation in the Events, and will adhere to the guidelines that my doctor recommends; I am physically able to participate in the Events; I do not suffer from ANY health condition which may be aggravated by participating in the Events, including, but not limited to, heart conditions or high blood pressure, back, neck or other skeletal, muscular, respiratory or circulatory problems.Consent to Medical Treatment. I consent to receive first aid, medical and/or surgical treatment, or any other services rendered to me, at my expense, in the event of an injury, accident, or illness I incur during my direct or indirect involvement with the Events. I agree and acknowledge that the Released Parties are under no obligation to provide such medical treatment. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT FIRST AID OR EMERGENCY RESPONSE OF THE RELEASED PARTIES OR OTHER INDIVIDUALS OR MEDICAL OR EMERGENCY PERSONNEL.Liability Release and Waiver of Claims. On behalf of the Releasors and in consideration for being allowed to participate in the Events and/or use of the Venue, I HEREBY WAIVE, RELEASE AND FOREVER DISCHARGE ANY AND ALL CLAIMS OR CAUSES OF ACTION, NOW KNOWN OR HEREAFTER KNOWN IN ANY JURISDICTION THROUGHOUT THE WORLD, AGAINST THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, ANY BODILY INJURY OR DISABILITY, ILLNESS OR DISEASE, ACCIDENT, DEATH, FINANCIAL LOSS, MEDICAL BILLS, PAIN AND SUFFERING, LOSS OF CONSORTIUM, EMOTIONAL DISTRESS, ATTORNEYS FEES AND COURT COSTS, PROPERTY LOSS, DAMAGE, DESTRUCTION, DELAY, INCONVENIENCE OR OTHER HARM OF WHATEVER NATURE THAT MAY BE DIRECTLY OR INDIRECTLY RELATED TO, ARISING FROM OR SUSTAINED FROM PARTICIPATION IN THE EVENTS AND/OR TRAVEL TO OR FROM OR VISIT TO OR USE OF THE VENUE OR ACTIVITIES RELATED THERETO, NEGLIGENT FIRST AID OR EMERGENCY RESPONSE OF THE RELEASED PARTIES OR OTHER NEGLIGENT ACT OR OMISSION OR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OF ANY RELEASED PARTIES OR OTHERWISE, even though this liability may arise through no fault of my own, or from the negligence or carelessness on my part or the part of the persons or entities being released, from dangerous or defective property or equipment owned, maintained or controlled by them or because of their possible liability without fault, provided that nothing in this section shall be deemed to release any Released Party from liability arising from their own willful or intentional injury to me or my property. The claims released hereby include, but are not limited to, any claims I may now have or may hereafter acquire resulting from injury, death, or property damage sustained by me, or to any property that I may own or have rented, leased or borrowed or have in my possession. Except for disclaiming liability for which the Released Parties are prohibited from disclaiming under law, the Released Parties hereby disclaim any and all liability and warranties for the Events. I acknowledge full and sole responsibility for my own medical expenses, and I am responsible for any and all medical expenses incurred on my behalf.Unpredictability of Cause; Personal Responsibility. I understand that injuries and harm may result from the Events, including working with and around sports, music or entertainment equipment and machinery from a variety of causes, including the acts or omissions of other persons, weather, ocean or water conditions, ground and environmental conditions and other causes not necessarily predictable or within anyone’s control. I agree and acknowledge that the Released Parties do not accept any responsibility for injury, illness, loss, or damages suffered by me and that obtaining insurance to cover these risks is my own responsibility. I assume all risk of personal injury, sickness, or death, and damage to or loss of my belongings and property, and any and all other delay, inconvenience, damage, loss or other expenses I may suffer as a result of or in connection with the Events. I agree to be fully responsible for my actions. I assume responsibility for my safety and that of others, including injuries, property damage and harm, to the fullest extent possible and regardless of the acts or omissions of others. Indemnification. I AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE RELEASED PARTIES, JOINTLY AND SEVERALLY, FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, DEMANDS, RIGHTS, LOSSES, COSTS, DAMAGES, EXPENSES, SETTLEMENTS, JUDGMENTS, CAUSES OF ACTION AND LIABILITIES OF ANY KIND WHATSOEVER, WHETHER FORESEEN OR UNFORESEEN, INCLUDING ATTORNEYS’ FEES, IN LAW OR IN EQUITY, ARISING OUT OF OR RESULTING FROM ANY CLAIM RELATED TO MY PARTICIPATION IN THE EVENTS, INCLUDING WITHOUT LIMITATION MY BREACH OF THIS AGREEMENT OR THE EVENT RULES AND POLICIES, MY ACCEPTANCE OR USE OF ANY PRIZE I MAY BE ENTITLED TO, INCLUDING ANY TAX LIABILITY IN CONNECTION THEREWITH, OR FROM ANY INDIVIDUAL I INVITE TO THE EVENT OR VENUE OR ANY OTHER THIRD PARTY CLAIM RELATED TO THE EVENTS.I expressly waive the provisions and protections of Section 1542 of the California Civil Code and any similar law of any jurisdiction. I understand that Section 1542 provides as follows:A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.I expressly acknowledge and understand the significance, effects and consequence of a waiver of Section 1542 and hereby assume full responsibility for such a waiver.Grant of Media Rights. I understand that the Events may be photographed, videotaped, or otherwise recorded, and I hereby grant to Company, IMC and WSL and each of the other Released Parties, and each of their respective successors, assigns, agents and licensees (collectively the “Recorders”), the irrevocable, perpetual and unrestricted (except as expressly set forth below) right and permission, but not the obligation, throughout the universe, with or without my knowledge, to photograph, video record, use, re-use, permit the use of, distribute, reproduce, record, upload, download, edit, dub, copy, digitize, synchronize, create derivatives, in whole or in part, post, publish, and re-publish, display, perform, exhibit, transmit and/or broadcast or otherwise use my appearance, photograph, signature, image, likenesses, actions, pictures, name, nickname/sobriquet, age, voice, conversation, sounds, biographical data, performance, interviews (including, but not limited to a written transcript), sound recordings, spoken word, rendering, silhouette, shape, body dimension, posture, or other reproduction by text, print, drawing, data, audio, illustration, animation, graphics, tape, film, video and/or images of me or in which I may be included, in whole or in part, in combination with or in composite, or distorted in character or form, without restriction as to changes, modifications (including blurring, distortion, or composite), or alterations and including pictures, images, video and audio uploaded or provided by me (collectively the “Recording”) and the right, throughout the world, to register for copyright, to use and to assign and/or license others to use all or any portion of the results thereof (or a reproduction thereof), in all media and in any manner now known or hereafter developed, in connection with the Events or the business of any of the Recorders or otherwise without any additional consideration. I shall have no right of approval and no legal claim arising out of any use or editing of the Recording or my name. Recorders shall have no obligation to use any of the rights I grant. I represent that it is not necessary for the Recorders to obtain permission from or to pay me or any third party in connection with the rights granted in this paragraph and for such use of the rights and the Recordings, I understand and agree that I will not be entitled to any compensation beyond my participation in or attendance at the Event. I acknowledge that I shall have no ownership, authorship or moral rights in the Recording or any part thereof. Further, I hereby waive all rights and release, discharge and shall neither sue nor bring any proceeding (including, without limitation, seeking any form of injunctive relief) against the Released Parties from and against any and all claims, demands, actions or causes of action, liabilities, costs, dues, sanctions, fees, penalties or expenses (including reasonable attorneys’ fees), of any kind, nature or description, which I or any of my successors or assigns may now, or at any time, have or claim to have, now known or unknown, arising out of or alleged to arise out of or related to any use of the Recordings, including, without limitation, any blurring, distortion, alteration, modification, optical illusion, or use in composite or any other form of the Recordings, whether intentional or otherwise, that may occur or be produced in connection with the Recordings, or in any subsequent processing, broadcasting, distribution, exhibition, display, dissemination or other exploitation or use thereof, including without limitation any claims of libel, defamation, public disclosure, invasion of privacy, misappropriation or infringement of my name or likeness or right to publicity, false light or any similar matter, or based upon or relating to the use and exploitation of the Recordings. In no event shall I have any right to injunctive or other equitable relief against any of the Released Parties in connection with the Recordings.This Agreement shall inure to the benefit of, and shall be binding upon, our respective successors, licensees, assigns, heirs and personal representatives. I agree and acknowledge that Recorders will have complete artistic and creative freedom and discretion and that each Recorder has the right, but not the obligation, to use, assign, license and sub-license the Recordings or any such related materials (in whole or in part) throughout the world, through any means or method of distribution whether now known or hereafter to become known, in perpetuity.In the event that any provision of this Agreement (or portion thereof) is determined by a court of competent jurisdiction to be invalid or otherwise unenforceable, such provision (or part thereof) shall be enforced or, if incapable of such enforcement, shall be deemed to be deleted from this agreement, while the remainder of this agreement shall continue in full force and remain in effect according to its stated terms and conditions. This Agreement shall be governed by and construed under the laws of the State of California, U.S.A., notwithstanding its conflict of law provisions. Any action or proceeding brought to enforce the terms of this Agreement or adjudicate any dispute arising out of this Agreement shall be exclusively brought in the State of California. The parties will not raise in connection therewith, and hereby waive, any defenses based upon venue, the inconvenience of the forum, the lack of personal jurisdiction, the sufficiency of service of process or the like in any such action, suit or proceeding brought in the State of California. This Agreement fully, completely, and exclusively sets forth my agreement with the Released Parties on the matters set forth herein and may only be amended in a writing executed by both the Released Parties and myself. I further represent and warrant that I am eighteen (18) years old or older, am legally competent to sign and have the right and power to enter into this Agreement and to contract in my own name or I have acquired the written consent of my parent or legal guardian. I have read the above authorization, waiver, release, grant of rights and agreement, prior to its execution, and I am fully familiar with the contents thereof. I understand that these terms are legally binding, and I have signed this document of my own free act. This Agreement shall be binding upon me and my heirs, legal representatives, and assigns.I UNDERSTAND THAT THE TERMS OF THIS AGREEMENT MEAN THAT I AM WAIVING CERTAIN IMPORTANT RIGHTS THAT I MIGHT OTHERWISE HAVE UNDER CALIFORNIA LAW.BY SIGNING BELOW I DO HEREBY EXEMPT AND RELEASE THE RELEASED PARTIES FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH OR ANY OTHER CAUSE OF ACTION, HOWEVER CAUSED, INCLUDING NEGLIGENCE, WHETHER PASSIVE OR ACTIVE. I HEREBY VOLUNTARILY WAIVE ANY RIGHT I MAY HAVE TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR LITIGATION INVOLVING ANY RELEASED PARTY. THIS AGREEMENT IS A BINDING LEGAL CONTRACT, PLEASE READ IT CAREFULLY BEFORE SIGNING.
