ANDERSON GASLIGHT FESTIVAL

CAR SHOW PARTICIPANT WAIVER AND INDEMNIFICATION

1. Liability Waiver and Indemnification. Participant intends to participate in the Car Show at the 2026 Anderson Indiana Gaslight Festival (“Festival”.) Participant hereby waives and releases any and all claims against the Festival, its employees, volunteers, members, directors, officers, or any other person associated with the Festival, for any liability, claims, demands, damages, costs, expenses, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant, its vehicles, tents, personal property or possessions, or any other person or property, while participating in the Festival or while in, on or upon the Festival premises, regardless of whether any such loss is caused by the negligence of Festival. Participant agrees to indemnify, defend and hold harmless the Festival from any loss, liability, damage, costs, including court costs and attorney fees, that Festival may incur arising out of or related to any acts or omissions caused, directly or indirectly, by Participant's participation in the Festival. This Liability Waiver and Indemnification Agreement is binding on the Participant, its agents, associates, volunteers, members, officers, agents, contractors, employees, heirs and assigns.

2. Right to Publish. Participant hereby grants the Festival the right to publish Participant's name, photograph, video, image, likeness, statements, testimonial, voice, or any other representation of Participant ("Likeness") for advertising, promotional or any other lawful purposes. Participant waives any right to inspect or approve any finished product or material that may be used in connection therewith.

3. Safety. Participant agrees to drive slowly and safely at all times while participating in the Festival’s Car Show. Participant, for itself and all others associated with Participant, shall obey all Festival rules, regulations, and policies, and shall be respectful of others attending or participating in the Festival events.

If Participant uses a tent, awning, canopy, umbrella, or any similar item, Participant shall use an abundance of caution to secure such items in the event of weather conditions that could cause them to create a hazard for people or property.

4. Inoperable Vehicles. In the event the Participant’s vehicle is inoperable, Participant shall remove the vehicle from the Festival grounds in a timely manner, as determined by the Festival, and any costs incurred by the Festival in removing the vehicle shall be paid in full by Participant.

3. Governing Law. This Agreement shall be governed by the laws of the State of Indiana without regard to its conflict of laws principles. Exclusive jurisdiction and venue shall be in the federal and state courts located in Anderson, Indiana.

4. Severability. If any provision of this Agreement is determined to be invalid or unenforceable, the remainder of this Agreement shall remain in effect and be construed as if the invalid or unenforceable provision were not contained herein.

5. Entire Agreement. This Agreement represents the entire understanding between the Parties with respect to the subject matter herein. This Agreement may be modified only by a written instrument signed by both Parties.

Festival rules, regulations, and policies

Car show Participant Rules & Expectations

· Participant check-in begins at 9:00 am and no later than 9:30 am

· Participants are to provide their own tables, tents, chairs, and displays should they desire them

· Tents must be of flame-retardant material and have a minimum of 20lbs of weight on each leg

· Electricity is not provided

· Participants must keep their parking area and surrounding areas clean and free of trash

· Participants may not use the Anderson Gaslight Festival name or logo

· ALL participants must comply with all city and festival ordinances/rule/regulations

· Hours of the festival are 9 am to 3 pm. It is requested that you stay the duration of the event

· We cannot honor requests for preferred positions

· Offensive and/or obscene materials are not welcome to be displayed and/or sold at the festival. These include, but are not limited to: confederate flags, nazi or communist symbols, or pornographic materials. Failure to comply will result in removal from the festival
