Description: Two experienced internal investigators will lead this 3.5-hour workshop. Through small group discussion and simulated interview/investigation exercises, Mary and Fran will provide in-depth training that complies with the new internal investigator qualification standard set by the EEOC.

Under new federal employment law guidance, all internal investigations into harassment claims must be conducted by an individual who is “well-trained in the skills required for interviewing witnesses and evaluating credibility.” Specifically, investigators must have a skill set for “interviewing witnesses” and “evaluating credibility.” This workshop will satisfy all aspects of this investigator training standard.

The workshop will cover the following:

  • Internal investigation basics
  • Respecting various employee rights throughout the investigation process
  • Structuring an investigation to ensure it is sufficiently thorough
  • Identifying and avoiding conflicts of interest in internal investigations
  • Understanding what “material facts” to an investigation are
  • How to evaluate the credibility of witnesses when faced with conflicting versions of events
  • How to effectively interview witnesses
  • Upon conclusion of the investigation, how to arrive at a determination that is a “reasonably fair estimate of the truth.”

Participants will receive copies of all training materials with key information and advice on the new EEOC standard, as well as a certification indicating the participant has received training to satisfy the EEOC’s internal investigator qualification standard.

Space is intentionally limited in this workshop to allow for meaningful small-group discussion and hands-on training from Fran and Mary.
