WORKSHOP 4: Thursday June 6th 2024

Informed and Empowered: Disability and Mental Health


Let's dive into the detail and learn with two subject matter experts:


  • ‘Mental Illness’ and ‘Psychosocial Disability’
  • Disability Royal Commission recommendations in respect of guardianship/supported decision-making and mental health laws
  • NSW legislation that disproportionately affects people with psychosocial disability - the Mental Health Act, Guardianship Act, NSW Trustee and Guardian Act and other related legislation
  • Duty of Care and Dignity of Risk
  • Disability and Mental Health
  • Disability and Mental Health and hospitalisation: The Mental Health Act (NSW) - ‘sectioning’, ‘scheduling’, involuntary patient orders (IPOs)
  • The Mental Health Act and Mental Health Review Tribunal
  • What is a community treatment order (CTO)?
  • Psychosocial disability and criminal charges in the NSW Local Court

Today's workshop will include multiple sessions of focused information, separated by breaks.


Meet our Speakers:

Ben Fogarty, Barrister

** Ben Fogarty's presentation will be pre-recorded and played during the June 6 workshop, due to Ben's responsibilities in his role as a Barrister meaning he cannot attend live on the day **

Since coming to the bar in October 2011, Ben has advised and appeared in a broad range of matters, with focus areas including Criminal law, Guardianship and Mental Health, and Discrimination, Disability and Human Rights.

In 2021 and 2022, Ben was junior Counsel Assisting the Royal Commission into Violence, Abuse, Neglect and Exploitation of People with Disability.

Prior to the bar, Ben worked extensively in the community legal and pro bono sectors, and has also published a number of articles in the Law Society Journal and the Alternative Law Journal on discrimination law, employment law and disability rights. He has also written chapters and booklets for the community legal sector on guardianship and financial management law and disability rights.

Ben also taught criminal law (as a part-time lecturer) at the Universities of Sydney and New South Wales between 2004 and 2012.

Tarnia Lee

Tarn is a highly skilled counsellor, trainer, and facilitator with twenty years experience working in the mental health, suicide prevention, drug and alcohol, and LGBTQIA+ health sectors.

Tarn is a passionate advocate for the mental health and wellbeing of marginalised communities, she has authored several journal articles, and speaks regularly on the systemic challenges faced by marginalised communities and the importance of peer driven community development.

Tarn has worked on several large-scale national projects in the LGBTIQA+, mental health and suicide prevention sectors, including the coordination of QLife, Australa's first national LGBTQIA+ teleweb service.

Tarn is currently undertaking a Master's degree in Emergency and Disaster Management.
