Rievaulx Spring Lakes are based at Bridge Road, Rievaulx, YO62 5LB. The location is surrounded by beautiful scenery, making it the perfect spot for a morning or evening swim. So, bring your swimsuit and get ready to connect with nature!

WAIVER AND RELEASE OF LIABILITY.

PLEASE READ CAREFULLY – ONLY PURCHASE TICKET IF YOU HAVE FULLY UNDERSTOOD AND AGREE.

I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE AND NEXT OF KIN, THAT MY PARTICIPATION IN ANY POOL BRIDGE FARM SWIMS, SWIMMING, INTRODUCTION TO OPEN WATER SESSION, OPEN WATER SWIMMING OF ANY KIND AND MY SIGNATURE ON THIS DOCUMENT MEANS THAT:

Assumption and acknowledgment of risk:

I know that there are significant inherent risks involved with open water swimming at Rievaulx Wild Swimming, including the serious risk of death or injury associated with swimming generally and cold water swimming in particular.

I ACKNOWLEDGE AND ACCEPT THESE RISK AND ALL OTHER RISKS ASSOCIATED WITH PARTICIPATION swimming in the lakes - even if arising from negligence or gross negligence, including any worsening of injuries caused by negligent first aid operations or procedures, Rievaulx Wild Swimming and any and all persons associated therewith or participating therein.

I understand that all applicable rules for participation must be followed and that, at all times, THE SOLE RESPONSIBILITY FOR MY SAFETY REMAINS WITH ME, including, but not limited to, my physical and emotional preparation and fitness.

I will immediately remove from the lake and notify the nearest member of staff if at any time I sense or observe any unusual hazards or unsafe conditions or if I feel that I have experienced any deterioration of my physical, emotional, or mental condition, which might render me unfit for continued swimming.

I give a FULL RELEASE AND WAIVER OF LIABILITY AND ALL CLAIMS that I have or may have in the future against Rievaulx Wild Swimming or the owners of Rievaulx Wild Swimming AND ANY RELATIVES OR RELATIONS THEREOF, AS WELL AS ANY VOLUNTEERS PARTICIPATING with any Rievaulx Wild Swimming swimming events, its directors, officers, employees, guides, representative, advertisers, other participants, sponsors, the venue at which the programme is held and its directors, officers, employees, guides and representatives (collectively known as the “releases”), from all liability for any loss, damage injury or expense that I may suffer as a result from my use of, or my presence at Rievaulx Wild, due to any cause whatsoever, INCLUDING NEGLIGENCE AND GROSS NEGLIGENCE, INCLUDING ANY COMPOUNDING OR AGGRAVATION OF INJURIES CAUSED BY NEGLIGENT FIRST AID OPERATIONS OR PROCEDURES OF THE PROGRAMME ORGANISER, THE PROGRAMME VENUE AND ANY PERSONS ASSOCIATED THEREWITH OR PARTICIPATING THEREIN, ; BREACH OF CONTRACT,OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT OR ANY OTHER RELEVANT STATUTES, on the part of the releases.

I AGREE NOT TO SUE the releases for any loss, injury, cost or damages of any form or type, however caused or arising, and whether directly or indirectly from my participation in the event and:

I AGREE TO INDEMNIFY, and to SAVE AND HOLD HARMLESS the releases, and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based o the negligence or gross negligence of the releases or otherwise.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume the full responsibility for my  participation; and:

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS RIEVAULX WILD SWIMMING, their coaches, volunteers, and/or employees, other participants, sponsoring agents, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to persons and property, WHETHER ARISING FROM NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to fullest extent permitted by the law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

BY SIGNING AND ADDING MY NAME IN PRINT, I AM CONFIRMING THAT I HAVE READ, UNDERSTOOD AND AGREE WITH ALL ASPECTS OF THIS DOCUMENT AND ITS GENERAL INTENT AND THAT I AM GIVING UP CERTAIN SUBSTANTIAL LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.

This is to certify that I, as parent / guardian with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risk of the activity and his/her responsibilities for adhering to the rules and regulations.  Furthermore, my child / ward do consent and agree to his / her release provided above for all the releases and myself, my spouse, and child / ward do release and agree to indemnify and hold harmless the released from any and all liabilities incident to my minor child / ward’s involvement or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by the law.
