The Texas Department of Housing and Community Affairs (TDHCA) has opened their Administrative Penalty Process and Debarment Rules for public comment until November 24th.

The Administrative Penalties
The Administrative Penalty rules outline the process that TDHCA uses to hold properties accountable when they do not comply with the program rules they must follow in return for state funding. This process includes a number of potential outcomes to hold properties accountable for not following the rules and require corrective action for the property to come back into compliance. Properties may be fined as a result of noncompliance, and this rule details specific fine amounts for various different issues.
The Debarment Rules
The Debarment rules outline how a property that repeatedly breaks the rules can be blocked from future TDHCA funding opportunities for a set period of time. This limits the relevant parties’ ability to be involved in additional HTC deals.
