From an initial evaluation to the termination of special education, State and federal laws dictate the steps that educators must take to ensure that students receive a free, appropriate education in the least restrictive environment. Those same laws impose specific, and sometimes burdensome, documentation requirements. The failure to comply with the substantive and procedural requirements of those laws may subject a school district to liability, whether through a state complaint, a due process hearing, or even litigation under Section 504 or other anti-discrimination laws. In this presentation, an experienced special education law attorney will explore common legal pitfalls facing special educators. Using real-world examples, the presenter will guide attendees through potential strategies for avoiding liability, both in the provision of services and the documentation that so often dictates the outcome of hearings and litigation.
