Description

Following the Supreme Court’s June 2014 decision in Alice Corporation v. CLS Bank, software remains eligible for patent protection. However, many existing patents have been invalidated as unpatentable “abstract ideas” under the Alice framework and experience shows that it is now much more difficult to obtain software patents from the USPTO.

We would like to invite you to a panel discussion that will address Alice’s impacts in its first year and strategies for filing and defending patent claims in its wake. Our distinguished panel will include:

  • Mel Chan, named partner of Aka Chan LLP, and a prominent patent prosecutor who has extensive experience in prosecuting patents in the post-Alice world.
  • Dana Rao, Vice President, Intellectual Property and Litigation at Adobe Systems Inc. and signatory to an important amicus brief in the Alice case, who will provide insight on how software corporations are navigating IP claims after Alice.
  • Robert McFarlane, litigation partner and Technology Practice Chair with Hanson Bridgett LLP, who will address post-Alice litigation strategy.

The panel will be moderated by Professor David Franklyn, Director of the McCarthy Institute at the University of San Francisco School of Law and Russell Petersen, a registered patent attorney who specializes in patent infringement matters as Senior Counsel at Hanson Bridgett LLP.
