The I-9 Form Update for 2026 does not introduce a brand-new Form I-9; however, it places critical emphasis on electronic system deadlines and I-9 Form expiration requirements. Employers currently using the Form I-9 (08/01/23 edition), which expires on July 31, 2026, must ensure their electronic systems are updated by that deadline to support the version expiring on, which expires on July 31, 2026 must ensure their electronic systems are updated by that deadline to support the version expiring on May 31, 2027.

The newly updated Form I-9 (01/20/25 edition) also carries an expiration date of 05/31/2027 expiration dateand includes minor but important updates, such as revised terminology (changing “gender” to “sex” in document descriptions) and an updated privacy notice. While these updates may seem small, they directly impact the I-9 Form process and employer compliance obligations.

With multiple electronic system deadlines in place, Employers must verify they are using the correct I-9 Form version based on expiration dates. These overlapping requirements often make the I-9 Form process confusing and increase the risk of costly fines and penalties if not handled correctly.

Additionally, the January 1, 2025, I-9 Form changes, though administrative in nature, remain unfamiliar to many Employers and must still be properly incorporated into daily onboarding and verification procedures.

Why This Webinar Matters:

Form I-9 is a fillable form, allowing information to be typed directly into the document except for signature fields. Employers and employees must print and manually sign the form, as this fillable version does not meet DHS standards for electronic Form I-9 generation, storage, or retention systems. Refer to 8 CFR Section 274a.2 for detailed requirements.

Failure to comply with DHS standards for electronically generated, stored, or retained I-9 Forms can result in substantial fines and enforcement penalties.

Employers and authorized representatives must understand that if the I-9 Form were simple, it would not require an 8-page instruction guide and a 60+ page DHS manual to properly complete a 1–2 page form.
