Frequently asked questions

Do I need an Estate Plan?

Yes—if you own property, have minor kids, or want control over your assets, you need an estate plan. Without one, Florida law decides who gets what, which may not match your wishes. You can also name guardians and choose who manages your affairs if you're ever incapacitated.

What is the difference between a Will and a Trust?

A Will takes effect after death, names heirs and a personal representative, and must go through probate. A Trust takes effect during life, avoids probate, and names someone to manage assets if you're incapacitated or die. Trusts offer privacy and faster distribution.

How do I plan for incapacity — if I can’t make decisions for my finances or health?

Florida lets you plan for incapacity with key documents: a Power of Attorney for finances, a Health Care Surrogate for medical decisions, and a Living Will for end-of-life wishes. Without them, loved ones may need court approval. Planning ahead with the right attorney ensures wishes are followed.
