Effective Terminations and Discipline: You're Fired! Cutting the Cord without Being Sued

One of the questions most commonly asked of an attorney is: "Can I fire this employee?" However, the number one way for a company to find themselves in a lawsuit is a "bad" termination. This presentation will cover, how to effectively terminate the relationship with an employee without facing liability at the end of the day.

2. What you can and cannot say during the termination meeting;
3. How and when you should use a severance agreement;
4. When you should not terminate an employee;
5. What it means to be an "at will" employee;
6. How and when to use progressive discipline;

8. Using personal improvement plans (PIP);
9. Layoffs including Cal/WARN; and
10. When you should get legal counsel involved.

Erica Rosasco is a shareholder at McKague Rosasco LLP in Roseville, California. Ms. Rosasco was also admitted for membership in the Traynor Honor Society. While at McGeorge, Ms. Rosasco served as a Production Editor and Staff Writer for the McGeorge Law Review. She was also a member of the Woman's Caucus and Phi Alpha Delta.

Ms. Rosasco is from a cattle ranching family and grew up in the central valley. She is a married mother of one active third grader. In her spare time, she enjoys wine tasting, working out with a dynamic group of friends, reading, cooking and gardening.
