A sample of the common problems that will be covered are:

Can a Payment Notice served late be treated as an effective Pay Less Notice?

Under NEC, if the contractor is assessing a compensation event as a forecast,

can the contractor include contingency in its quotation?

Is a written instruction a condition precedent to payment for a variation even if

it is proven that the contractor has carried out additional work?

What happens if the client refuses to instruct a variation in writing? Should the

contractor carry out the work if it believes the work to be a variation?

If materials are delivered to site by the contract, does the property in such

materials automatically vest with the client if the contract is silent?

Is the contractor liable for the cost of correcting a defect if the client appoints

others to correct it without notifying the contractor?

Is the contractor automatically entitled to a contribution to preliminaries when

valuing a variation based on a fair valuation?

All problems will be discussed with reference to different standard forms (e.g.

JCT and NEC) and highlight any recent case law that supports the solution.
