Synopsis:The presentation will address the expanded liabilities that design-build entities face as opposed to entities that provide only design services.  It will also explain the difference between the various types of insurance coverage available to design-build entities, focusing on commercial general liability coverage, contractor’s professional liability coverage and architects/engineers/design professional liability coverage.  The presentation will then provide a hypothetical or two where a design-build entity is faced with a situation that could result in a claim or lawsuit being brought against it.  We will discuss how the design-build entity can walk the fine line between “doing the right thing” and working with its clients and partners to resolve the issues while best protecting itself if a claim or a lawsuit arises.  This will include taking steps to best ensure that insurance coverage will be available by meeting the very different requirements and obligations required under the different types of insurance policies, preserving evidence and avoiding spoliation of evidence charges, and ensuring that other entities such as subcontractors (or their insurers) accept their share of responsibility for the problems.

 

Speaker Biography:  Janice Greenberg is a Senior Claims Specialist in the Construction Professional and Pollution Liability business unit of XL Catlin.   In her current role, Janice handles both litigated and non-litigated professional and pollution liability claims submitted by insureds in design and construction fields throughout the country.  Prior to joining XL Catlin, Janice spent more than 19 years as an attorney counseling and representing primary, umbrella and excess insurers in connection with complex pollution, construction and professional liability matters and has litigated dozens of declaratory judgment actions involving insurance coverage issues in state and federal courts throughout the United States.  Janice received her Bachelor of Science degree magna cum laude from the State University of New York at Brockport in Brockport, New York and her Juris Doctorate cum laude from the Maurice A. Deane School of Law at Hofstra University in Hempstead, New York.  Janice is currently licensed as an attorney in New York.
