What are Due Process and Fair Hearings?

The Office of Administrative Hearings solves special education disputes between parents and school districts. Under the law, students who have disabilities have specific, guaranteed rights to a free appropriate public education (known as "FAPE"). When a disagreement develops between parents and school districts regarding the education of a student with a disability, a neutral third party is often needed to help resolve the disagreement.

The Office of Administrative Hearings (OAH) will provide a presentation to families regarding how to access their rights under the Individuals with Disabilities Education Act (IDEA).

The presentation covers:

  • Overview of Office of Administrative Hearings

  • Basic due process rights under the Individuals with Disabilities Act

  • How to access Office of Administrative Hearing's services

  • How to present your case at mediation and at a hearing.
