Legal and Tech Updates. Review the latest developments in case law, court rules and policies impacting mediation in Michigan. With the group’s help, we’ll also share new and improved strategies for mediating online.

Reality Testing. Reality testing is a critical tool frequently used by mediators to foster movement in negotiations. But is there only one “reality” we can test? Learn more about the breadth of this tool and how powerful it can be.

Overcoming Impediments to Self-Determination. Improve your mediations by helping participants feel more secure during their negotiations and protecting those hard-won settlement agreements from later attack on the grounds of coercion or duress. We’ll explore lessons from Michigan’s experience with domestic violence screening in divorce mediation to glean ways we can better assure self-determination and ensure durable agreements in all of our mediations, both domestic and general civil.

Outcome Confidentiality & NDA’s. Are mediators unintentionally helping to conceal abuse and create other harm to participants and third parties by facilitating nondisclosure agreements (NDA’s) inside settlement agreements? Delving into this new hot topic in our field, we’ll consider the implications of NDA’s and explore a wider range of alternatives for you to use in facilitating agreements.

Accommodating Disabilities. Are mediators legally and/or ethically obligated to accommodate disabilities in their mediations? How can you manage this accommodation process to better ensure that all participants are fully engaged in their negotiations? We’ll use real life scenarios and resources to help you create better mediating environments and opportunities for agreement.

**Pre-Game Stretch. View and reflect on mediation resources including video and articles. Details will be sent following registration. For the full 8 hours of AMT credit, articipants must submit “homework” before game day because there will only be 7 classroom hours on January 26. The homework assignment will be sent to registered attendees the first week of January for completion and return by January 22, 2022.

SCAO approved for up to 8 hours of advanced civil or domestic mediation training required by MCR 2.411 (F)(4) and MCR 3.216(G)(3) to remain on court rosters. As explained above, the full 8 hours consists of 7 hoursof in-class training plus 1-hour of pre-session homework.

HOMEWORK:

To obtain all 8 hours of advanced mediation training credit, you will need to complete a homework assignment. The homework assignment is estimated to take less than one hour to complete and is due no later than 5:00 PM on January 25, 2022.
