Decorate a special pumpkin for Halloween. Space is limited RSPV your spot now!

$5 per participant. Bring your own pumpkin. We will provide space and art supplies.

NO CARVING. Safe for kids of all ages. Parents must be present at all times.

Social media will vote for their favorite pumpkin. Winner of the contest will pick up their prize from Tradition Sqaure on November 1st.

By Registering for this class, I agree to the below waiver: WAIVER AND RELEASE FOR PARTICIPATION IN AND USE OF RECREATIONAL ACTIVITIES & FACILITIES

The undersigned, in consideration for myself and my family members, tenants, guests, and invitees participation in any activity, including but not limited to social events, fitness classes, etc., offered by the Tradition Community Association, Inc. (the “Association”) and / or use of any common area, recreational facilities, or any portion thereof, furnished by the Association, including, without limitation, Town Hall, Town Square and its surrounding areas, a clubhouse, fitness center, pool(s), tennis court(s), basketball court(s), and/or any other area(s) intended for social and recreational use (individually and collectively, the “Recreational Activities & Facilities”) which is offered by, owned by and/or maintained by the Association, hereby executes this Waiver and Release (“Release”) and acknowledges and agrees as follows:

1. I, for myself, my family members, tenants, guests, and invitees, understand that I am responsible for my safety while using and/or participating in the Recreational Activities & Facilities and agree that such responsibility includes, but is not limited to, using the Recreational Activity & Facilities only after fully familiarizing myself with the safe use of and participation in, any activity only when I am physically able and psychologically prepared to participate in any offered activity and/or use of the applicable Recreational Activities & Facilities and understand I am responsible for my family members, tenants, guests, and invitees being similarly physically able and psychologically prepared.

2. I, for myself, my family members, tenants, guests, and invitees, understand and acknowledge that the general use of the Recreational Activities & Facilities bears both known risks, including the risk of COVID-19, and unanticipated risks that could result in serious injury, permanent disability, death, illness, disease, emotional distress, damage and/or loss to me and/or my property as well as to third parties and/or their property. I acknowledge and agree that I know, understand, and appreciate the risks (known and unanticipated) of the use of the Recreational Activities & Facilities. I know that these known and unanticipated risks may result from my own actions, the actions of others, or a combination of both. By executing this Release, I acknowledge and agree that I am voluntarily using the Recreational Activities & Facilities, and am hereby voluntarily accepting and assuming all risk (known and unanticipated) of injury, permanent disability, death, illness including, but not limited to illness related to COVID-19, disease, emotional distress, damage and/or loss to me and/or my property and to third parties and/or their property that are associated with or that may occur during or as a result thereof.

3. I, for myself, my family, my heirs, my legal guardians, my personal and legal representatives, my estate, my successors and my assigns, hereby voluntarily release, waive, relinquish, surrender and forever discharge the Association, and its officers, directors, agents, members, employees, contractors, representatives, Founder, and successors and assigns (collectively, the “Released Parties”) from any and all losses, liabilities, claims, actions, causes of action, damages, costs and/or expenses which I may have for personal injury, property damage, wrongful death, or otherwise arising out of or in any way connected with my use of the Recreational Activities & Facilities. I understand that this waiver includes any claims based on any action or inaction, negligent, intentional, or otherwise, of the Released Parties and/or any other person. IT IS MY INTENTION BY THIS WAIVER AND RELEASE TO GIVE UP ANY RIGHT THAT I MAY HAVE TO SUE OR BRING LEGAL ACTION AGAINST THE ASSOCIATION (AND ANY OF ITS CLUBS) FOR PERSONAL INJURY OR PROPERTY DAMAGE WHICH MAY ARISE OUT OF MY USE OF THE RECREATIONAL ACTIVITIES & FACILITIES.

4. Should any of the Released Parties be required to incur attorneys’ or paralegals’ fees or other costs or expenses to enforce this Release, whether or not any proceeding is actually commenced, I agree to indemnify and reimburse them for such costs and expenses through all pretrial, trial and appellate levels and proceedings. This Release and any disputes arising under or related to it will be governed and interpreted pursuant to the laws of the State of Florida, without regard to its conflicts of law rules, and venue for any such actions shall be in St. Lucie County, Florida. I waive any right I may have to a trial by jury in any action, suit or proceeding brought to enforce, defend or interpret any right or remedies under, or arising in connection with or relating to, this Release. This Release is intended to be as broad as is permissible under the laws of the State of Florida. If any provision of this Release shall be found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from this Release and shall not affect the validity and enforceability of any remaining provisions. No failure by the Association to enforce any part of this Release shall constitute a waiver of any of their rights under this Release, whether for past or future actions on the part of any person. Only a specific, written waiver signed by an authorized representative of the Association shall have any legal effect whatsoever. This Waiver and Release cannot be modified orally.

I HAVE CAREFULLY READ THIS RELEASE AND FULLY UNDERSTAND ITS TERMS AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS HEREIN. I FURTHER UNDERTAND THAT THIS IS A RELEASE OF LIABILITY WHICH PRECLUDES ME FROM PURSUING ANY CLAIMS AGAINST THE ASSOCIATION FROM DAMAGES AND/OR INJURY I INCUR. I HAVE SIGNED THIS RELEASE FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND THIS RELEASE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
