Immigrants arrive in the United States from diverse corners of the earth, bringing equally diverse experiences, hopes, and dreams. But all, or nearly all, undocumented immigrants share in emotional turmoil derived from the threat and fear of deportation. The impact of deportation on individuals and their families is well documented by those who work closely with targeted immigrants. Uncertainty and anxiety mark the lives of children and other family members. But how much do courts take into account the cultural and familial contexts that give shape to the lives of undocumented immigrants targeted for deportation? What do they know of the conditions of the defendants’ country of origin? And if they don’t know, how can they be made aware?

This is exactly the role of the mental health and country conditions expert witnesses in immigration hearings. It is important for a third-party expert witness, who is unbiased and with expertise in a particular area, to inform the immigration court about the facts and consequences of these issues. Lawyers, mental health and country conditions experts who attend this session will learn about the critical role of expert witnesses in various types of relief used in immigration proceedings.

We will address:

  • How and when to use mental health and country conditions experts

  • What types of relief require the use of experts and

  • Sample testimony of mental health and country condition experts used in immigration hearings

  • The importance of the rapport and exchange of information between the expert and the immigrant’s legal team

The William Alanson White Institute Center for Public Mental Health was founded to employ psychoanalytic understanding and expertise in addressing social and mental health issues. The Center focuses its work on urgent concerns facing policymakers, academic researchers, government agencies and influential thought leaders. Our aim is to establish a context for thoughtful dialogue, within and among various disciplines including psychoanalysis, mental health, healthcare, public health, organizational psychology, education, business, advocacy, and government. Our initiatives may include but are not limited to creating a public space for dialogue, training first responders or other service providers, developing psycho-educational materials for clients and service providers, working with philanthropic and governmental organizations to help assess their public health agendas or programs, researching public mental health issues, promoting collaborative efforts with other like-minded organizations and possibly providing direct treatment through one of the Institute’s training programs. The Center collaborates with other organizations that are active in the public mental health arena to accomplish its goals.

The William Alanson White Institute of Psychiatry, Psychoanalysis and Psychology has distinguished itself as one of the world's most prominent and respected psychoanalytic training and treatment centers for nearly 75 years. In addition to our education programs for psychiatrists, psychologists and social workers, our clinic provides low cost mental health treatment for children, adolescents and adults in the NYC area.
