Dear Friends,

antitrustitalia's 42nd lunch talk is scheduled on Tuesday 28 November 2017 at the Auditorium of the Madou Tower at the European Commission's Directorate General for Competition (DG COMP) in Place Madou 1049 Brussels.

Giuseppe Conte, member of the European Commission Legal Service, will give a presentation in English on:

"Selective tax measures in EU State aid law "

The notion of material selectivity in EU State aid law raises complex questions that are key to determine whether national measures, in particular in the tax area, constitute State aid. Those questions, which have acquired a prominent role in the framework of recent Commission investigations on national tax planning practices and tax rulings, have given rise to lively debates among academics and practitioners and an important body of case-law. Following two judgments of the General Court which quashed Commission decisions on this point, those questions have been quite recently examined by the Grand Chamber of the Court of Justice in the World Duty Free Group and Hansestadt Lübeck cases. Giuseppe's presentation will discuss that case-law, trying to provide a systematic view of the Court's judgments and to explain apparent contradictions.

After specialising in EU law at the Brussels University (ULB), Giuseppe worked two years in Brussels and Rome in the boutique law-firm of Professor Antonio Tizzano. When Professor Tizzano was appointed Advocate General at the European Court of Justice in 2000, Giuseppe followed him as his "référendaire". In 2004, Giuseppe joined the European Commission, first in DG Comp's "Merger Network" and, three years later, in the State aid team of the Legal Service. Between 2008 and 2012, Giuseppe was seconded to Ms Kroes' Cabinet, where he was responsible for State aid matters and, subsequently, for electronic communications regulation. Back in the State aid team of the Legal Service, he led the joint working group with DG Comp in charge of drafting the Commission communication on the notion of State aid. In 2015 he joined the Competition team of the Legal Service, where he still works. Giuseppe published a number of articles and contributions to EU law books, in particular on competition matters, and acquired a PhD in EU law at the University of Naples.
