As a startup looking for financing and seed money, you not only need to have a game plan for protecting your intellectual property assets, but you also need to consider how you intend to market and sell your products/services. In this session, we will discuss the various ways in which you can select, clear, and protect the intellectual property of your company. We will talk through the options, and also discuss the pros and cons to each option. In addition to discussing how to select the right type of IP protection from the outset, we will cover what could happen if you don’t take the necessary steps to protect your IP and other details regarding the following topics:

Kurt A. Kappes
Kurt is a Managing Shareholder at Greenberg Traurig, and has extensive experience counseling national and international clients in the areas of trade secrets, restrictive covenants, covenants not to compete, and employee mobility. He lectures frequently in this area, and has contributed to many articles and alerts. As an Adjunct Professor, Visiting Professor, and Visiting Lecturer in Law at King Hall School of Law, University of California, Davis, Kurt taught a course in trade secrets and employee mobility for nearly a decade.. He graduated from Northwestern University Pritzker School of Law. The GT Trade Secret Practice is ranked among the top 20 firms nationally in the Legal 500 United States 2019 Guide. The Guide also recommends Kurt in the area of Trade Secrets (litigation and non-contentious matters).

Dash McLean
Dash focuses his practice on branding issues, including trademarks, copyrights, and Internet-related intellectual property matters. He counsels clients on selection, proper use, registration and enforcement of U.S. and foreign trademarks and copyrights, has represented startups in Silicon Valley for 20 years, and has prosecuted over 3,000 trademark applications. Dash is experienced drafting and implementing trademark and copyright licenses, settlements, and coexistence and consent agreements, and he frequently advises clients on brand development and the intellectual property aspects of mergers and acquisitions including due diligence and agreement drafting, as well as Digital Millennium Copyright Act (DMCA) issues.

Andrew B. Schwaab
Andrew is second-generation patent attorney who has also practiced in the Silicon Valley and SF Bay Area for almost 20 years representing startups and emerging companies. He focuses his practice on strategic patent counseling from startup to exit, including all facets of patent protection, developing global patent portfolios, patent litigation, licensing, validity and infringement analyses, due diligence, and freedom-to-operate issues. Andy has an Electrical Engineering degree from the University of Virginia and handles matters related to a wide range of electrical and computer technologies, with an emphasis on software and emerging technologies.
