Legal and Tech Updates. Review the latest developments in case law, court rules and policies impacting mediation in Michigan. With the group’s help, we’ll also share new and improved strategies for mediating in the online tech environment.
Reality Testing. Reality testing is a critical tool frequently used by mediators to foster movement in negotiations. But is there only one “reality” we can test? Learn more about the breadth of this tool and how powerful it can be.
Mediator Disclosures. How do you decide what you disclose to potential parties? We’ll look at a new tool developed by the ADR Section to guide mediators in what they may/must/don’t have to disclose.
Mediating Non-Disclosure Agreements (NDAs). Are mediators unintentionally helping to conceal abuse and cause further harm by facilitating inclusion of NDAs inside settlement agreements? Delving into this new hot topic in our field, we’ll consider the implications of NDAs and explore ways mediators can promote party self-determination resulting in satisfying agreements.
Accommodating Disabilities. Are mediators legally and/or ethically obligated to accommodate disabilities in their mediations? How can you manage this accommodation process to better ensure that all participants are fully engaged in their negotiations? We’ll use real life scenarios and resources to help you create better mediating environments and opportunities for agreement.
Pre-Session Assignment. To obtain the full eight hours of advanced mediation training credit, attendees will need to complete a pre-session assignment. The assignment is estimated to take one hour to complete and requires trainees to consider and reflect on engaging videos and articles. Details will be sent upon registering.
SCAO Approved. The State Court Administrative Office has approved this training for up to eight hours of advanced civil or domestic mediation training required by MCR 2.411 (F)(4) and MCR 3.216(G)(3) to remain on court rosters. The full eight hours of credit consists of seven hours of in-class training plus a one-hour, pre-session assignment.
