Every patient’s healthcare information is protected by a complex set of state and federal laws, the most significant of which is the Health Insurance Portability and Accountability Act (“HIPAA”). Understanding how these laws protect patient privacy is essential when responding to demands from family members, subpoenas, and even a patient’s request for her own information. In this training, two attorneys who regularly work with counselors, therapists, and other mental health professionals will provide a roadmap for navigating information requests under state and federal law. This seminar will provide general advice so you can protect yourself and your patients, and address general questions you may have about how the law addresses mental health information.

Cost:

$10 for 1.5 CEUs (pending approval). Please provide payment at the training. Proceeds will go to presenters and to support future Consilience Institute community events.

Presenter Bios:

Mark Lancaster, J.D., is a partner at Luxan & Murfitt, PLLP. Since entering private practice in 2009, Mark has served as general counsel for several nonprofits, and businesses, and governmental entities. His work involves both advice and document preparation on transaction matters, but also litigating matters in state and federal courts.

Lucas Hamilton, J.D., M.B.A., is an associate attorney at the firm of Luxan & Murfitt, PLLP. Lucas has worked with health care providers in various fields on matters ranging from payment to privacy. Prior to entering private practice, Lucas worked for the Montana Supreme Court and the Montana Commissioner of Securities and Insurance.
