Stretching IRAs' Benefit for the Future


Standalone Retirement Trusts*

Choosing a beneficiary for a retirement account seems easy: most people choose their spouse, their children, their parents, or their siblings. But only the first in that group can actually roll over the funds into their own IRA so the funds can continue to grow, tax-deferred, until that person's own retirement. What happens when the other beneficiaries inherit an IRA might not be what the holder intended; it might also be inadvisable in many financial situations.

In this presentation, estate planning attorney Jana R. McCreary will expain an option for your clients to benefit those other beneficiaries. She will discuss how using that option--a specific standalone trust--can help your clients provide for their children and grandchildren, using their IRA savings while gaining from the tax-deferred growth. Being aware of how an estate planning attorney can structure such a trust for your clients could add great value to your clients’ financial plan as they consider options for these accounts.

Jana R. McCreary, J.D, LL.M.

Jana R. McCreary, owner of McCreary Law Office, P.A., graduated with her Juris Doctor, summa cum laude, in 2002, later earning her Masters of Laws at Southern Methodist University. She opened McCreary Law Office in 2014 to provide personalized and individuated estate planning services for clients, focusing on plans that seek to provide peace of mind, protection of assets, and assurance for loved ones.

Before practicing law, Jana worked for over a decade with adults and children with intellectual disabilities and mental illness in acute then in long-term care. After law school, Jana spent three years as an attorney with the Court of Appeals for the Fifth District of Texas at Dallas before transitioning to academia. She taught law for eight years, in Texas, Tennessee, and then Florida. Her work in long-term care, her devotion to education and teaching, and her personal experiences with estates and probate contribute to a dedication and passion in her law practice.

Most recently, McCreary Law Office has begun to expand to include Elder Law in its practice areas, working to help clients sort out complex family and financial situations often faced by seniors and persons with disabilities.

Jana, a third-generation Texan, has called Florida home for almost nine years. But her Texas roots remain strong--from an ancestor who fought in the Alamo to four generations (she was in the third generation and the first female in her family) of graduates from Texas A&M University. In her personal life, in addition to cheering for the Aggies in SEC football, Jana's passion is travel, having visited over thirty countries on five continents.
