Best Practice for Brokers & Associate Brokers

Real estate brokers licensed at the highest state levels set standards of practice in the area and are tasked with maintaining high levels of customer/client service and compliance with all state-based real estate laws along with Federal laws such as Fair Housing Law. Real estate brokers Instructs and trains or provides training resources for their agents and is responsible for agent behavior, performance, and legal compliance.

Considerable risk exists in the operation of a brokerage. To minimize this risk, let’s discuss the following topics.

  • The Affiliation Contract, MLS/FMLS Agreement, Marketing Agreements with Third Party Companies
  • New Terms: “As Is”, Multiple Offer Procedure, Overbidding, Coming Soon Signs, “Best and Final”, “Highest and Best” Request
  • What are you required to disclosure?
  • Advertising and Marketing, Social Media Code of Ethics
  • Cycle Security – Data Breach, Protecting the Consumers Private Sensitive Identifiable Information
  • Fair Market Value Opinion, Commission, “Added Value” Services
  • Reviewing Offers, Agreements, Contracts, Risk Management
  • BRRETA, Branding and Establishing Niche Markets
  • Sales Meetings, Code of Ethics, Code of Care, Code of Conduct

Georgia law sets forth the responsibilities owed by real estate brokers and sales associates to their clients. This same conduct can also be grounds for a lawsuit. Real estate agents work anywhere, anytime and they are their own boss….the bottom line, you must be organized in managing your associate brokers and agents. Do you know what they are doing in the field when you don’t see them?  It may surprise you and set up for a compliant.
