Motions to Quash Pretrial Subpoenas for Victims' Records

Crime victims' personal records are routinely sought by defendants in criminal cases; and those records are routinely turned over by third party record holders as well as the victims themselves without much protest. The reasons may include a lack of knowledge of privacy and other rights held by the victims, misperceptions of defendants' rights, lack of knowledge regarding how to respond to such requests, and more. This program will discuss the common grounds raised in support of defendants' pretrial "discovery" of victim records, review a checklist of legal arguments that may be asserted in victims' motions to quash, and provide practice pointers for victims' attorneys.

MCLE Accreditation: An application will be submitted to Oregon State Bar for 1.0 general MCLE credit.
