An Important Breakfast Briefing for Finance and HR Professionals: How to Manage the Financial and Reputational Risks of using Temporary Workers

Recent high profile cases have highlighted the potential reputational risks to end users of using Temporary Workers when there are non-compliant practices within their supply chain. The political rhetoric now regularly turns to this subject, and there are currently several discussion papers on the subject, with an expectation that legislation will follow, including moves to place financial liabilities and name and shame announcements on the end clients found to have non-compliant supply chains

From our own experience, there remain several unsavoury practices prevalent within the industry, which can be difficult for end users to detect, including:

  • Not paying adequate (or any) holiday pay to Temporary Workers.
  • Not providing Temporary Workers with the same basic terms and conditions after 12 weeks.
  • The use of complicated supply chains including Umbrella Companies.
  • A general misunderstanding of IR35 rules.
  • Manipulation of the Flat rate VAT scheme for financial gain.
  • Manipulation of the NICs Employment Allowance for financial gain.
