On February 12-14, 2021, a vendor event shall be held at the St. Charles Towne Center. We are looking for vendors with unique merchandise. Only one vendor from one direct company. E.g. only a paparazzi vendor from Paparazzi. If you are interested, please read the rules, check the vendors list below and if we do not already have a vendor in your category and you agree to all the rules, you may sign up for our event. Paying to be part of the event means you accept all the rules.

The Event Manager is the organizer of the afore mentioned event and the vendor is engaged in the business of direct sales and/or local merchant. Shopping Center Name (DBA) and Address: St. Charles Towne Center 11110 Mall Circle, Suite 1016, P.O. Box 6040 Waldorf, MD 20603

Fees covers vending area, permit and insurance. All fees are NON-REFUNDABLE, and all spaces are on a first paid basis, NO HOLDS. Events may be postponed because of COVID19 (we are hoping not) by the event organizer. New dates will be communicated to all vendors at least 4 weeks before the new dates to allow for adequate preparation on the part of the vendor.

Please note that after paying, we will email to ask about your products and if it fits with her event, we will send an email to confirm your participation. If not, you will be promptly refunded.

GENERAL RULES

SETUP/BREAKDOWN Setup starts 1hr before mall opens. Breakdown starts an hour before the mall closes. Arrival 30 minutes before or after the mall opens will disqualify the vendor and fees paid WILL NOT BE refunded. All vendors should be set up 15 minutes before the mall opens to the public. Vendors can leave any time after 6pm.

TABLES AND CHAIRS Vendors will bring their own table and chair. A vendor is allowed a table and a rack or just one table. Event table set up shall be decided by event organizer and not vendors. Vendors shall follow all instructions given and not decide anything out of what the organizers as stated.

MERCHANDISE:A. Vendors shall only BRING MERCHANDISE STATED AT THE TIME OF APPLICATION. Merchandise shall be in the same category.

B. Merchandise shall be professionally displayed.

Extra Inventory: All extra inventory should fit under the table or taken back to the car. Vendors shall not store any inventory, equipment or any other materials outside the space, or do or permit anything to be done in or about the Space or appurtenant common areas which would constitute a nuisance or hazard or which will in any way obstruct or interfere with the rights of other tenants or occupants of the Shopping Center or injure or annoy them.

Space: Vendors shall occupy and use the Space for the period stated above, commencing on the Start Date/Time and ending on the End Date/Time (‘Term’), unless sooner terminated as herein provided. Vendors also shall only sell items agreed upon. We reserve the right to ask any vendor that do not abide by these rules to leave.

Indemnity and Exculpation of Landlord: (a) Tenant shall assume liability for and shall indemnify, defend and hold harmless House of Beulah LLC. Landlord, Landlord's Property Manager, Simon Property Group, Inc. (and all their respective shareholders, members, partners, directors, officers, related and affiliated entities, ground lessors, managers, employees, and agents) (collectively, 'Landlord Parties') against and from any and all liabilities, obligations, sickness, losses, penalties, actions, suits, claims, damages, expenses, disbursements (including legal fees and expenses) or costs of any kind and nature whatsoever in any way relating to or arising out of: (i) any act or omission of Tenant (including without limitation the acts or omissions of the Tenant's officers, directors, employees, agents, contractors, invitees and/or licensees within the Shopping Center); (ii) any occurrence which takes place in or about the Space; or (iii) any damage to the Space. To the extent permitted by applicable law, Tenant's duty to indemnify Landlord Parties under this paragraph will apply regardless of and will extend to cover losses caused by either Tenant's or Landlord Parties' concurrent, comparative or contributory negligence.(b) Landlord Parties shall not be liable to Tenant, and Tenant waives all claims against Landlord Parties, for injury, death or damage to person or property sustained by Tenant, or any person claiming through Tenant, resulting from any condition, accident or occurrence in or upon the Space or any other part of the Shopping Center, unless such matters arise from the intentional wrongdoing of Landlord Parties. (c)To the fullest extent permitted by applicable law, Tenant shall indemnify and save Landlord Parties harmless from any and all claims, demands or suits that may be brought against Landlord Parties by any employee, representative, or agent of Tenant, or any legal representative or successor of any of them, in any way arising out of or incident to this Lease, irrespective of whether such suits are brought about by the negligence or fault of Landlord Parties or anyone for whose acts Landlord may be liable. Space Condition Tenant agrees not to harm the Space, commit waste, create any nuisance, make any use of the space, which is offensive, as determined by Landlord at its sole discretion, or act in a manner tending to injure the reputation of the Shopping Center. Vendors must return the space the same way it was before set up. All damages will be the responsibility of the vendors.

Losses: Theft, loss or damage to merchandise and personal property is the sole risk and responsibility of Tenant. Thank you so much for choosing to pop up @ our space.

We cannot predict what a day would be like, we have no control over sales. We will expose vendors to mall traffic, advertise the best we can but also ask vendors to advertise to their regular customers.
