The First Step Act: What are the Next Steps for Practitioners?

The Carrico Center continues its popular Law Over Lunch CLE series with a program that takes a deeper look at new federal laws that seek to reform sentencing processes and the prison system as a whole, with a broader goal of decreasing recidivism.

The Formerly Incarcerated Reenter Society Transformed Safely Transitioning Every Person Act of 2018 (“First Step Act”) is a broad package of bills that not only retroactively applies the Fair Sentencing Act, it governs the treatment of current inmates – from how good conduct time accrues to compassionate release policies for the terminally ill. However, as many of the policies affect a significant number of the current prison population, questions have been raised as to how these individuals can access these new opportunities – and how prosecutors, defenders, and the courts will manage their cases.

Robert Wagner and Laura Koenig, with the Federal Public Defender’s Office for the Eastern District of Virginia, will share more details on these new laws – what they cover, what they do not – and how practitioners can navigate these uncharted waters of review.

Robert Wagner
Supervisory Assistant Federal Public Defender
Office of the Federal Public Defender – Eastern District of Virginia

Laura Koenig
