"The Psychology of Settlement" (Updated for 2018!)
This session is designed for mediators, attorneys and anyone interested in "WHY" people do what they do in negotiations. We will explore the psychology behind the behaviors exhibited by participants in a negotiation or mediation and, most importantly, we'll see how understanding these behaviors will help you maximize your results in any negotiation situation whether your role is as an attorney or mediator. We'll look at topics such as persuasion theory, reactive devaluation, confirmation bias, sunk cost fallacy and other cognitive biases that will help you identify the best practices for effective negotiation and mediation. This segment will be an interactive, fast-paced, multimedia-based presentation that relies on recent research, case studies and real-world scenarios.

"Best Practices of Effective and Profitable Mediators" (Updated for 2018!)
This session will review best practices of effective and profitable mediators. Are you maximizing your mediation opportunities? Would you like more cases? Would you like to better manage your mediation cases? Would you like repeat business from satisfied attorneys and companies who use mediation frequently? We'll look at every stage of the life of a mediation case to identify the methods, procedures, settlement techniques and business systems that will help you to be a more effective -- and more profitable -- mediator. This segment will help you to be better -- and busier -- than you've ever been.

"Mistakes Mediators Make" -- Mediators become successful by doing what works … and by avoiding what does not work! We’ll explore both of these concepts in this interactive, multi-media based segment entitled “Mistakes Mediators Make.” We will learn what TO DO to be successful in mediation . . . and what NOT TO DO to avoid lawsuits, ethical complaints and the dreaded “bad word of mouth” – which is more common than lawsuits or ethical complaints but will cause major damage to a mediator’s professional success. We will review recent ethics opinions, real-world complaints against mediators, and lawsuits against mediators as we learn to avoid the Mistakes Mediators Make!

"Overcoming Impasse" -- Ultimately, mediators will only be "successful" if they can seal the deal in most of their mediations. This segment will explore proven strategies for overcoming impasse and give practicing mediators (and negotiators) new tools to assist them in reaching resolution in tough mediations!

Attorneys will earn 6 hours of CLE credit (including 1 ethics hour) for the full-day program. We will report your attendance to the Mississippi Bar upon successful completion of the program.

Do you need CLE credit in another state? Our seminars have been CLE-approved since 1995 in every state in which our programs have been offered. Course participants have also received CLE credit in their home states after attending one of our training programs out-of-state. (Our course has never been denied CLE approval in any jurisdiction). This course is open to anyone interested in learning to mediate and/or increase their skills in resolving conflict. There is no pre-requisite to attend.

Nearly every mediation training seminar we present sells out. We limit the number of students in each program to maximize your learning experience (usually 20 participants or fewer, depending on location). This small group experience will enable each attendee to receive individual attention. We encourage you to register early so that you can get a seat in the course that is most convenient for you.


Troy Smith, JD began mediating in 1992 and has been a mediation trainer for over 24 years. Over 7000 mediators have completed his training programs nationwide. Troy began offering one of Mississippi's first mediation training courses in 1995 and has trained over 1000 mediators and attorneys in Mississippi since that time.

Full Refund. Your seminar fee is fully refundable if you cancel your registration 21 or more business days prior to the first day of the seminar, less a $15 administrative fee. All cancellations must be received in writing or via email.

Reschedule Anytime. If you must reschedule your attendance at a seminar -- even at the last minute -- you may transfer your registration to another equally priced seminar within 24 months of the date of your original program. All reschedule requests must be in writing and received prior to the start of the seminar. (No-shows will not be eligible to reschedule).

Substitutions. If you are unable to attend a seminar for which you have registered, you may send a substitute in your place. If you need to send a substitute, we ask that you notify us at least 1 day in advance of your seminar, if possible.

Event Cancellation. In the highly unlikely event that Mediation Media, Inc. must cancel or reschedule a program for which you are registered for any reason, we will refund your registration fees or transfer your registration to another program, whichever you choose. Mediation Media, Inc. is not responsible for participant expenses related to a program cancellation.
