Ethics: A review of Ethical Dilemmas in Mediation

1.0 Hour Ethics MCLE Credit

Presenters: Hon. Cecily Bond (Ret.), Hon. Frank Damrell (Ret.), Hon. Robert Hight (Ret.)

Description: Hear from retired federal and state court judges on how to navigate ethical dilemmas in mediation hearings. Timely ethical scenarios will be discussed and questions of ethical boundaries answered. Topics to be explored include:

  • Discussion of new CA Rules of Professional Conduct, relevant ethical codes under ABA Model Rules, Business & Professional Codes
  • Best practices for navigating ethical dilemmas in mediation from the perspective of retired judicial officers
  • Review of relevant case law

An Insider’s View: effective Advocacy in Mediation & Arbitration

1.0 Hour General MCLE Credit

Presenters: Deborah Ballati, Esq., Hon. William Cahill (Ret.), Gary Davis, Esq.

Description: JAMS neutrals Gary Davis, Esq. and Hon. William Cahill (Ret.) will have a panel discussion moderated by Deborah Ballati, Esq. about how to be an effective advocate in mediation and arbitration. The panel will draw on their collective decades of experience and discuss ways to mediate and arbitrate disputes while saving time and money in order to reach fair, efficient resolution. Topics to be explored include:

  • What cases are right for arbitration and how to prepare for arbitration
  • How to position a case for mediation, get beyond impasse, and develop creative settlement terms
  • How to negotiate effectively & deal with difficult negotiators

Encountering Bias in Litigation

1.0 Hour Elimination of Bias MCLE Credit

Presenters: Adrienne Publicover, Esq., Jeane Struck, Esq.

Description: In this program, Adrienne Publicover and Jeane Struck discuss recognizing bias (including implicit and explicit bias), responding to bias, and playing to bias within the context of litigation. Topics to be explored include:

  • Defining unconscious bias
  • Discussion of examples of bias
  • Skill building: recognizing and interrupting bias
