Why view this session?

The changes to rules governing IR35, due to come into force in April this year, were delayed by Covid-19. The ongoing effect of the latter on the economy and businesses resulted in MPs agreeing that the legislation be postponed to April next year (they voted against another proposed change which would have delayed implementation until April 2023).

For now, it appears that the IR35 changes will be effective from 6 April 2021. Those medium and large private sector businesses that engage freelancers and contractors via an intermediary (such as a private service company (PSC) or partnership) are likely to be affected. HMRC is cracking down on tax avoidance and the use of PSCs, through which individuals provide their services, as these are perceived as a means for companies to avoid paying NICs and PAYE. This tightening up of IR35 will have a significant impact on how companies engage contractors and the implications of getting it wrong are serious.
