Intellectual Property Value in Startup Investments: A View from Silicon Valley

Intellectual property assets (IP Assets) have been the driving force behind high-tech startups, but often times investors fail to understand their unique value as strategic business assets. Investors tend to focus on the defensive value of IP Assets, as it relates to protecting the company’s own products, but that is a very narrow point of view that entirely misses the full value of these assets for investors. This problem gets exacerbated as more and more startups turn to leverage their IP Assets for both equity and debt funding.

In this seminar, the speaker will present the Startup IP Valuation Model, which is an IP valuation framework that has been developed in order to improve the understanding and communications between startups and their investors. This model establishes four types of investor/investment combinations, and identifies the main source of value that IP Assets can bring investors in each of these situations. This is a global model which applies across geographies, and is applicable for any IP practitioner involved with IP creation, startup formation, IP investment and startup funding. Along with the model, the speaker will share case studies from her 25 years of experience as an IP valuation expert in Silicon Valley, as well as a Stanford Lecturer on IP valuation at the Stanford Graduate School of Business.

Efrat Kasznik is President of Foresight Valuation Group and a Lecturer at the Stanford Graduate School of Business. Ms. Kasznik is a Silicon-Valley based IP valuation and strategy expert with over two decades of consulting experience, focusing on assisting IP holders across industries with the valuation, commercialization, and monetization of their intangible assets. She helps clients, ranging in size from Fortune 100 companies to start-ups, with IP and business valuations in support of licensing deals, IP and technology acquisitions, M&A transactions, financial reporting, strategic planning, and fundraising. She frequently serves as a testifying expert in disputes involving IP and startup valuations and damages.

Ms. Kasznik served as Chair of the High-Tech Sector (2019-2020), and is currently serving as Chair of the Valuation Committee of LES USA-Canada. She is also a member of the Board of the LES Silicon Valley Chapter. Ms. Kasznik has been recognized as one of the top IP strategists in the world by IAM 300 every year since 2013. Throughout her career, Ms. Kasznik has also served as co-founder and adviser to several Silicon Valley start-ups, and held the position as CFO at a telecom start-up. She currently serves on the advisory boards of several start-ups, accelerators and venture funds in the United States, Europe, Asia and Israel. Ms. Kasznik holds an MBA from the Haas School of Business at the University of California, Berkeley and a BA in accounting and economics from the Hebrew University, Jerusalem.

Before HLI, Pallavi served HP (Hewlett Packard), Sun (now Oracle), and Sarnoff Labs (Stanford Research Institute) for over two decades in various business, product, and technology management as well as hands-on engineering roles.

Pallavi is also a published author (whose work is cited by 200+ publications, including by many of the mega-cap internet and media companies), and the inventor of 18 worldwide patents (cited by 260+ other patents) who has served as Board Observer for VC-funded Silicon Valley company, chaired the MPEG4-Java international standards committee, and contributed to the ISO image and video compression standards.

Pallavi holds a B.S. in Electronics and Telecommunications Engineering from the Savitribai Phule University of Pune (MH, India), and an M.S. in Electrical Engineering from Utah State University (UT, USA). She has also passed the FINRA Series 79 and 63 certification examinations.
