Course Description*

This course examines the origins and development of international criminal law, from the Nuremberg and Tokyo Tribunals to the International Criminal Court. We will study the “core crimes” of international criminal law (crimes against peace, genocide, crimes against humanity, war crimes, and aggression), theories of liability (joint criminal enterprise, command responsibility, co-perpetration, indirect perpetration), and defenses (legality, superior orders, duress). In addition to covering doctrine, we will focus on questions concerning the goals and functions of international criminal law and the distinctive features of international and national responses to the core crimes.
