Description

Course Objective: Give participants a working knowledge of the purpose and benefits of the FOI Law, international context and processes for dealing with requests as prescribed by FOI legislation.

Course Outline:
Day 1: Provide an overview of the aims of the FOI Law and a clear understanding of legal procedures and best practices for processing FOI requests. Includes:

  • International context, legislation, background & philosophy
  • The objects, structure and scope of the FOI Law
  • How to identify and begin processing requests
  • Procedural grounds for refusing or deferring FOI requests

Day 2: Equip participants with the necessary knowledge and tools to feel confident making decisions on access to records that are the subject of FOI requests. Inlcudes:

  • Exemptions and the public interest
  • Redaction and partial access
  • Making decisions and giving reasons
  • Forms of access and fees

Day 3: Explain additional rights and procedures provided for in the FOI Law and discuss appeals, oversight, enforcement, proactive publication and miscellaneous issues. Includes:

  • Third party personal information and consultation
  • Amendment and annotation of records
  • Internal reviews and appeals
  • The role of the Information Commissioner
  • Disclosure logs, Publication Schemes and Codes of Practice
  • Protection from liability, offences and whistleblowers
