OVERVIEW

  • If you are going to jury trial with a client of color, you should be concerned about juror implicit bias.
  • Evidence shows that in criminal cases, white juries are more likely to convict black and Hispanic defendants.
  • There is no reason to think that in civil trials, white juries are any different.
  • That’s because we all have negative attitudes and stereotypes about people of color. Jurors bring these unconscious attitudes to the courtroom.
  • What’s a lawyer to do?
  • This program explores “race-conscious” voir dire, and other tools for addressing juror implicit bias, such as the juror education video and jury instructions adopted by the federal court for the Western District of Washington.
