Death is inevitable, however chaos at the closing table and busted deals do not have to be. This CLE, designed for both Real Estate practitioners and those focusing on Estate Administration, discusses the various ways title passes through and outside estates. We will focus both on statu-tory requirements for title to pass, but also what the title insurance industry requires for current and future transactions. We will also discuss how to protect purchasers from the claims of creditors (including Medicaid liens), when it is necessary for the personal representative to join in the conveyance, and how to handle land transfers when an estate is being administered in an-other county or state. Suggestions on properly drafting deeds and what items should be includ-ed in the estate file will be also be provided.
