  How to Protect the
Consumers' Private, Sensitive Information

Consumer Privacy - also known as customer privacy, involves the handling and protection of sensitive personal information that individuals provide in the course of everyday transactions. As the internet has evolved into a medium of commerce, consumer data privacy is a growing concern.

Real estate practitioners keep sensitive personal information in their files—names, contact information, Social Security numbers, photos, earnest money check showing the bank routing number, contracts with signatures, or other personal data—that identifies customers and clients.

This information often is necessary to client files, identify needs and goals, or perform other necessary business functions. However, if sensitive data falls into the wrong hands, it can lead to fraud, identity theft, or similar harms. Given the cost of a data breach—losing your files and clients’ trust and perhaps even defending yourself against a lawsuit—protecting the private, sensitive, identifiable information is just plain good business.

As an independent contractor you should have an established appropriate plan to protect your information whether on your desktop, tablet or hand held device.  Regardless of where you store and/or send information, the principles in this class will go a long way toward helping you keep data secure.

The law requires agents to:

  • Adhere to disclosure requirements and information sharing
  • Protect non-public personal information (NPI)
  • Guard information about transactions between the individual and your business and other information that you obtain e.g. court records, credit score
  • Protect Classified data
  • Cautiously send electronic exchanges
  • Sensibly share information with third party vendors
  • Learn how does encryption support your business and protect your client’s information
  • Carefully transfer information from your cell phone
  • Recognize phishing – the fraudulent practice of sending emails purporting to be from reputable companies
  • Protect data leakage and vulnerabilities, i.e. mobile and websites
  • Avoid password sharing
