Hot Button Topic: How The Landmark New Civil Trade Secret Law Affects You

Trade secret litigation is increasingly a hot button issue for Chinese Americans. In recent years, we saw increased criminal prosecutions against Chinese American individuals and Chinese companies for criminal theft of trade secrets. While those concerns still remain, in May 2016, a new era dawned in trade secrets litigation with the enactment of the Defend Trade Secrets Act (DTSA), the first federal civil misappropriation of trade secrets law. DTSA has significant implications for employees and multinational employers because this new law confers on U.S. federal courts jurisdiction over civil claims of trade secret misappropriation and will impact a wide range of critical business and legal strategies for both employers and employees.

CALOBA (Chinese American Lawyers of the Bay Area) and Orrick Herrington & Sutcliffe LLP are presenting a FREE seminar on trade secrets from the civil and criminal perspective, with an emphasis on civil trade secret issues due to the recent enactment of DTSA. We have included speakers with significant experience on trade secrets litigation, including a “Hall of Fame” thought leader on trade secrets law who testified before Congress on DTSA. Come learn about the new law, what to watch out for, and how to minimize your risk in a post-DTSA world.

This program will be presented in both Chinese and English. Lawyers, scientists, engineers, business owners, and the general public with trade secrets concerns are all welcome to attend! Refreshments and appetizers will be served. MCLE credit will be offered.

Speaker Profiles:

James Pooley is Senior Counsel in the Silicon Valley Office of Orrick, Herrington & Sutcliffe. He is a trade secret specialist and a member of the IP Hall of Fame, testified before the Senate on the DTSA, and has been credited by Congress as “instrumental” in fashioning the DTSA. In 2009, the White House appointed him Deputy Director General of the World Intellectual Property Organization, an agency of the United Nations, where he was responsible for the international patent system. Mr. Pooley has also served as the president of the American Intellectual Property Association (AIPLA) and is the current chairman of the National Inventors Hall of Fame Selection Board. Full bio.

Zheng (Jen) Liu is Of Counsel in the Silicon Valley office of Orrick, Herrington & Sutcliffe. She has more than thirteen years of experience in complex litigation, particularly intellectual property and commercial litigation. She regularly advises Chinese companies on how to conduct business in the U.S. legally. She is a frequent speaker in the Bay Area Chinese professional community on these matters, particularly trade secrets matters and how they affect the community. Before obtaining her J.D. from UC Berkeley School of Law, she had extensive scientific background in physics, biology and molecular virology. She went to University of Science & Technology of China for undergraduate and may conduct part of her presentation in Chinese for the lay audience. Full bio.

Robin Linsenmayer is Of Counsel in the Silicon Valley office of Orrick, Herrington & Sutcliffe. She focuses her practice on white collar criminal defense, internal corporate investigations, and other government investigations and enforcement matters. Ms. Linsenmayer has previously defended Chinese nationals accused of Economic Espionage. Prior to joining Orrick, Ms. Linsenmayer was a federal criminal prosecutor in the Southern District of New York. She also has extensive experience in cases involving wire fraud and mail fraud, securities fraud, antitrust offenses, and the Foreign Corrupt Practices Act. Full bio.

Cathy Lui is a Senior Associate in the San Francisco office of Orrick, Herrington & Sutcliffe who specializes in trade secrets litigation, and has particular expertise in obtaining and defending against temporary restraining orders and preliminary injunctions under exigent circumstances in fast-paced trade secret actions. Ms. Lui’s practice is across multiple jurisdictions in both federal and state courts, and involves a variety of different types of trade secrets including technical secrets, financial information, and products and sales information. Ms. Lui’s trade secret practice often involves parallel criminal proceedings. Ms. Lui regularly speaks and writes about trade secrets litigation. She is an editor of Orrick's trade secrets blog, Trade Secrets Watch. Ms. Lui attended Harvard Law School, and earned her B.A. and M.A. from Stanford University. Full bio.
