Description

This fast-paced interactive presentation will focus on how to legally and effectively interview and hire qualified, trustworthy employees and reject the “bad apples”. The presentation will also outline best practices for handling employee complaints, investigating employee misconduct, and imposing discipline, up to and including termination. It is targeted at large and small employers wanting a primer on starting, maintaining and terminating the employment relationship to mitigate and avoid the risk of litigation and, most of all, to foster a safe workplace for your employees.

Speakers

James K. Gumberg is a partner with the law firm of Patane•Gumberg∙Avila, LLP, where he heads the firm’s labor and employment law department. Jim represents small, mid-size and Fortune 500 companies in large-scale and collective cases as well as single-plaintiff employment and wage and hour cases in state and federal courts throughout California, from inception of suit to trial and arbitration, including discrimination, wrongful termination, wage and hour and whistle blower cases. Jim also has extensive experience defending employers in unfair labor practice charges and union elections before the ALRB and NLRB. He also counsels clients on day-to-day personnel issues and preparation of employment-related documents. He received his B.A. from the University of Florida and his J.D. from Santa Clara University, where he was a member of the Santa Clara Law Review. He is a member of the State Bar of California, Monterey County Bar Association, State Bar Labor and Employment Law Section and Agricultural Personnel Management Association.

Ignascio G. Camarena II is a partner with the law firm of Patane∙Gumberg∙Avila, LLP. Ignascio is a seasoned employment litigator with over 15 years of experience. He represents small and mid-size companies in single-plaintiff and class-action employment and wage and hour cases in state and federal courts in California. Ignascio also defends employers against wage and hour and retaliation claims before the Division of Labor Standards Enforcement and California Labor Commissioner. His day-to-day practice includes counseling employers in the construction, restaurant, and labor staffing industries on best practices in hiring, discipline, and termination as well as employee safety issues. Ignascio received his B.S. from San Jose State University and his J.D. from Golden Gate University School of Law, where he was a published author and Senior Editor of the Law Review. He is a member of the State Bar of California and admitted to practice before the United States District Courts for the Northern, Southern, Central and Eastern Districts as well as the Ninth Circuit Court of Appeal and the United States Court of Appeals for Veteran’s Claims. Ignascio is conversational in Spanish.
