Health Complaints Act 2016 – what does it mean for aged care workers in Victoria?

In April 2016 the Victorian Parliament passed the Health Care Complaints Act 2016. This new legislation came into effect in early 2017.

The changes in the legislation have important implications for both registered and unregulated workers in the Aged Care sector, including that the health services commissioner has been replaced by a new Health Complaints Commissioner. The associated changes mean that the new commissioner will have additional powers to take action where there are complaints against health providers and professionals who are not registered under the national health practitioner regulation law, including working as Personal Care Attendants in both residential and community aged care services. The commissioner is also able to initiate its own investigation, even if an official complaint has not been lodged.

ANMF (Vic Branch) has organised a seminar entitled: Health Complaints Act 2016 – what does it mean for aged care workers in Victoria. This seminar is designed for aged care workers and providers in Victoria and we are delighted to confirm that the following guest speakers are available to present:

  • Ms Karen Cusack, Health Complaints Commissioner who will explain the changes relating to the Code of Conduct and the full range of powers conferred to the Commissioner by the Act
  • Mr Philip Gardner, Partner, Ryan Carlisle Thomas Lawyers who will outline the associated responsibilities for regulated and unregulated health professionals and the associated aged care providers
  • Ms Lauren Todorovic, Director of Aged Care Report Card who will outline the services that are provided by the Aged Care Report Card

In addition ANMF (Vic Branch) officials will outline the advice/support available to ANMF members in relation to this new legislation.
