This course satisfies the MD requirement for Psychologists for continuing education in ethics.

Intermediate and Advanced Level

Target audience: Mental health care providers of all kinds whose clients may be exposed to domestic violence, or who may be supervising providers in both public and private institutions.

This CE class is offered via live webinar as well as in-person. Please select the ticket type that you prefer.


Abuse. What acts are abuse under Maryland law? What about stalking? What acts are abuse of a child (including mental injury) under Maryland law? Is neglect of a child also abuse? When should a victim seek a protective order? What is the mental health care provider's role?
Who Gets What. What's the difference between a domestic violence proceeding and a peace order proceeding? Who is eligible for each kind of relief? Is there any difference in the acts which justify granting these orders? Is there any difference in the relief?

Red Flag Law. Does Maryland have a "red flag" law? How does it work? Who can apply? Can a mental health care practitioner apply?


Reporting. When does mandatory reporting apply? Does it apply to the full range of acts which are abuse or neglect of a child? Is there any discretion? Can I be sued for reporting? Are there licensing or criminal penalties for not reporting?


Privileges. Does the patient-therapist privilege apply in domestic violence, peace order, or red flag proceedings? When should a practitioner speak up ‒ and when refrain from doing so? What if either the victim or the abuser is a child?


Learning Objectives

This workshop is designed to help you:
• Identify acts of abuse and child abuse under Maryland's domestic violence laws.
• Identify persons eligible for relief under Maryland's domestic violence laws.
• Predict whether a protective order or peace order can be obtained.
• Recognize when you must report conduct and the consequences of not reporting.
• Decide when to speak up ‒ and when to refrain from doing so ‒ in domestic violence cases.
• Prepare clients for the process of obtaining a domestic violence order, peace order or "red flag" order.


Presenters

Neal J. Meiselman, an experienced family lawyer and mediator who has practiced law in Maryland since 1978, is founding partner of Meiselman Helfant & Wills, LLC. Mr. Meiselman is the author of "12 Commandments for Divorced Parents," first published by Ann Landers in her nationally syndicated column on January 23, 1994. The Maryland Bar Journal published Mr. Meiselman's article, "Recession and Divorce," Volume XLIII, Number 1, January/February 2010. Reported cases include Noffsinger v. Noffsinger, 95 Md.App. 265 (1993); and Walker v. Grow, 170 Md.App. 255 (2006).


Nogah B. Helfant has concentrated her practice in the area of family law in Maryland since the year 2000. Ms. Helfant has extensive litigation, mediation, and negotiation experience in contested divorce cases, protective orders, high conflict custody cases, modification, and post-divorce enforcement proceedings. Ms. Helfant is frequently appointed by the Circuit Court for Montgomery County, Maryland to serve as a Child Privilege Attorney or Best Interest Attorney in contested custody cases. Reported cases include Campitelli v. Johnston, 134 Md. App. 689 (2000), and Walker v. Grow, 170 Md.App. 255 (2006).


Vincent M. Wills joined Meiselman Helfant & Wills LLC as a partner in 2018, after 22 years with Dragga, Hannon & Wills, LLP. Since 1996, his practice has concentrated primarily on family law, and particularly on complex litigation and appellate matters. Mr. Wills is former Co-Chair of the Family Law Section of the Maryland State Bar Association. He has been a frequent lecturer for the Maryland State Bar Association and the Montgomery County Bar Association. He has co-authored numerous published articles and training materials on topics in family law.

In October 2018, Mr. Meiselman and Mr. Wills co-presented "Determining Income For Child Support Purposes in Above Guidelines Cases" for the Montgomery County Bar Association. In November 2019, Mr. Meiselman, Ms. Helfant, and Mr. Wills presented "Family Law: Focus On Domestic Violence" at the Maryland Psychological Association's annual meeting.
