Is your startup company focused on open source software? Do you devote more than 50% of your time on OSS research and development? If so, your United States Employer may be able to claim H-1B cap exempt eligibility on your behalf in collaboration with WHOmentors.com, Inc., a nonprofit research organization. You must be willing to assign, convey, and otherwise transfer all rights, title, interest, and copyright ownership of the software project and assign original authorship to WHOmentors.com, Inc. to formally release the software to benefit the public.
See Example 2: Guidance Regarding Eligibility for Exemption from the H-1B Cap Based on §103 of the American Competitiveness in the Twenty-First Century Act of 2000 (AC21) (Public Law 106-313)
NOTE: H-1B cap exempt category was created by the US Government to ensure adequate supply of skilled labor available to United States Employers in certain important sectors. Sponsorships under cap-exempt category can occur throughout the year and at anytime. There is no need to wait until April 1st.
