Event Canceled- Latest Development of Chinese IP Courts

The first specialized IP court in China was established in Beijing in November 2014. Two others were formed shortly after in Shanghai and Guangzhou. These three specialized IP courts have changed the IP enforcement landscape for domestic Chinese and foreign IP rights holders. These appellate-level courts, as in most civil law system and unlike the U.S. appellate review, adjudicate both facts and law issues, but have different appellate jurisdictions from each other. For example, the Beijing IP Court has appellate jurisdictions over appeals from disputes of patents, new plant varieties, IC design, technology secrets, and software from first instance courts in Beijing. It also handles certain administrative appeals from the Patent Reexamination Board relating to issued patents, new plant varieties, and IC designs. Its appellate jurisdiction over administrative appeal over the Trademark Reexamination Board is also limited. The Shanghai IP Court would handle, on the other hand, appeals from first instance courts in Shanghai.
It has been two years since these courts were established, and we are pleased to host a program and welcome Ms. Yulian Hu of the Beijing IP Court to discuss the latest development in Chinese IP Courts.
About Ms. Hu
Ms. Yulian Hu has been a Patent Examiner with Patent Examination Cooperation Beijing Center since 2002 and has handled substantive patent examination of patent applications in mechanical, chemical, material sciences, and pharmaceutical areas. In 2014, she was selected to be a Technical Public Assessor (special master) of Intellectual Property Court of the Beijing First Intermediate People’s Court, a pre-cursor court to the current Beijing IP Court. She helped adjudicated more than 70 trials involving patent administration and civil cases.
