Educational Event Synopsis
The educational event on Social Media and Employment will explore the novel legal scenarios created through the growing use of social media platforms at the workplace, both by employers in the course of their business, as well as by employees for their private purposes. The issues covered will include the use of social media and the vetting of candidates in the recruitment stage, the possible limitation on use of social media platforms at work, and the possible vicarious liability of the employer in relation to actions committed by his employees online.

The seminar will also deal with ownership disputes of social media accounts, followers and likes, employee misconduct carried out online, and the use of social media policies as the best way to regulate employees’ rights and obligations in this regard.



Speakers' Bio

Dr. Paul Gonzi
Partner Fenech & Fenech Advocates

Paul Gonzi is a partner at Fenech & Fenech Advocates specialising in Labour Law, Data Protection and ICT Law. After graduating with a Bachelor of Laws, Diploma of Notary Public and Doctor of Laws at the University of Malta in 2006 he earned his Master of Laws (LLM) at Queen Mary and Westfield College, University of London. He has nine years of hands-on experience advising clients and as a litigant in various fora, including before the Courts, the Industrial Tribunal, in arbitration and also at Appeal stage in matters of employment, industrial relations, data protection and telecoms. He is the author of various publications and also contributes towards several conferences in his areas of specialisation.


Dr. Thomas Bugeja
Associate, Fenech & Fenech Advocates

Thomas Bugeja is an associate at Fenech & Fenech Advocates specialising in Employment law, Technology, Media & Telecoms and General commercial law. Thomas graduated with a Bachelor of Laws, Diploma of Notary Public and Doctor of Laws at the University of Malta in 2014 and takes a particular interest in the legal developments brought about by the growing use of technology at the workplace, this after having concluded his thesis on the “Social Media Implications on Employment, a Legal Minefield” in 2014. Over the past 2 years within the firm, together with the rest of the team, Thomas has assisted employers and employees with legal issues including before the Courts or the Industrial Tribunal, in matters relating to employment, discrimination, trade secrets, consumer law, data protection and telecommunications. He is the author of various publications and regularly participates in conferences on the above matters.
