Mental Health Issues in HOAs

HOAs must focus on managing property and corporations, but the human side of living together in community cannot be ignored. The mental health of our community members can profoundly affect the way we maintain property, enforce rules, conduct meetings, and generally interact with each other. This presentation will examine techniques for effectively recognizing and handling instances where mental illness and incapacity disrupt community functions and suggest ways to better care for community members and ourselves.

Partner Melissa Ward, Esq. joined Hughes Gill Cochrane Tinetti in 2016. She has been representing homeowners associations since 2010 in all aspects of their corporate operations. Prior to 2010, Ms. Ward practiced as a corporate and real estate attorney handling transactional business and real estate matters, as well as real estate litigation involving mortgage lending and foreclosures, ADA/disability access, partition claims, environmental and land use matters, construction defects, title insurance, and lease disputes.

When overlooked, poorly done or misunderstood, this long-term capital budget planning tool can create the biggest challenges for your HOA. This session will teach you why reserve studies and capital budgeting are so important and what you can do to protect the value of your home.

Roy Helsing is the Founder and CEO of The Helsing Group, Inc., which began as a reserve study firm 30 years ago. Still a national leader in reserve studies, the company has since expanded to provide community management services to over 200 associations and 30,000 homeowners throughout the Bay Area and Sacramento regions. Mr. Helsing is an original founder of the Association of Professional Reserve Analysts (APRA) and a co-author of the first reserve study standards nationwide.

Marc Tamres is Founder and CEO of HomeRun IQ, which provides expert long-term HOA financial planning and management simplified with technology. Marc is an investment advisor representative, with degrees in engineering and business from MIT. He continues to serve as president of his HOA.


Legal Update: New Legislation & the Anatomy of the Balcony Bill

This session will provide an update on recent case law and legislation impacting California community associations. The discussion will include an analysis of the pending ‘Balcony Bill – SB326’ and the impact that it will have on associations. The focus will be on the most significant changes in the law that may impact your communities and what you can do to be prepared and avoid liability or costly litigation.

Tyler Berding, Esq. founding partner of Berding & Weil LLP, has represented the commercial and residential real estate industry since 1974. Mr. Berding has litigated numerous building product and construction failures. The firm has resolved over 700 complex construction-defect claims in California, Florida, Arizona and Hawaii. His special expertise has been in water intrusion, soil issues, failed building systems, and building-product failures. He primarily represents residential building owners and commercial investors.

Spencer Edgett, Esq. was admitted to the State Bar of California in 2002. Mr. Edgett joined Chapman & Intrieri, LLP in 2004 and since that time has primarily focused his practice on representing community associations both as general counsel and in successfully prosecuting numerous construction defect claims resulting in tens of millions of dollars recovered for our clients. Mr. Edgett also regularly advises and assists community association and condominium board members on all aspects of management and operations.
